A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING TWO EASEMENTS LOCATED AT
1150 NORTH MAGNOLIA AVENUE PURSUANT TO
CALIFORNIA STREETS AND HIGHWAY CODE SECTION
8330, ET SEQ. SUMMARY VACATION. (Abandonment No.
ABA 2008 00176)
WHEREAS, an applicant has requested the vacation of two public service easements
located at 1150 North Magnolia Avenue, Anaheim California, in connection with a proposed
expansion to an existing office building, in which applicant was required to dedicate right -of -way
and provide public right -of -way improvements; and
WHEREAS, on April 8, 2008, the City Council granted applicant's request for
waivers of the public right -of -way and the right -of -way improvements;
WHEREAS, the public service easements to be vacated are not necessary for present
or prospective public utility purposes; and
WHEREAS, the easements to be vacated are superseded by relocation of public
utilities and there are no other public facilities located within the easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the two public service easements, as set forth in two
Easement Deeds Recorded on February 14, 2008 as Instrument Numbers 2008 00067604 and 2008-
000067605 of Official Records, Orange County, State of California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 24th day of June 2008, by the following roll call vote:
AYES: Mayor Pringle, Council Members Hernandez, Sidhu, Galloway, Kring
