RES-2008-146and RESOLUTION NO. 2008 -146 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM RATIFYING THE PRIOR SUBMISSION BY THE FIRE DEPARTMENT OF A GRANT APPLICATION FILED ON BEHALF OF THE CITY OF ANAHEIM TO THE DEPARTMENT OF HOMELAND SECURITY FOR CITIZEN CORPS PROGRAM NATIONAL EMERGENCY TECHNOLOGY GUARD (NET GUARD) PILOT PROGRAM, AND, IF AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH GRANT BY THE FIRE CHIEF, OR HIS DESIGNEE, ON BEHALF OF THE CITY AND AMENDING THE BUDGET FOR FISCAL YEAR 2008 -09 ACCORDINGLY WHEREAS, the U.S. Department of Homeland Security (the "Grantor has heretofore invited public agencies, including the City of Anaheim, to submit applications to the Grantor for the Citizen Corps Program National Emergency Technology Guard (NET Guard) Pilot Program for Fiscal year 2008 -2009 (the "Grant); and WHEREAS, said application had to be filed by July 2, 2008 and re -filed by July 18, 2008; and WHEREAS, in order to meet the deadline, the Fire Department filed said applications on behalf of the City of Anaheim in order to be eligible for such Grant; and WHEREAS, the City is familiar with the terms, conditions and limitations of any such Grant; and WHEREAS, the City is willing and able to conform to each of the terms, conditions and limitations imposed upon any such Grant to the City; and WHEREAS, the City desires to accept any such Grant which may be awarded to the City; WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant so awarded to the City, and to increase the annual appropriations and expenditures in the appropriate City program to reflect such award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The City Council hereby ratifies filing of the Grant on behalf of the City of Anaheim by the Anaheim Fire Department and hereby authorizes the Anaheim Fire Chief or his designee, or the Anaheim Fire Emergency Preparedness Division Chief, or the Anaheim Assistant City Manager to execute any actions necessary for the purpose of accepting and administering the Grant, if awarded, in order to obtain federal financial assistance provided by the federal Department of Homeland Security (the "Grantor and subgranted through the State of California, including any extensions and amendments thereof. 2. The City Council of the City of Anaheim hereby agrees to, and by this resolution, does accept any such Grant so awarded to the City of Anaheim without further action of the City Council being required therefor. 3. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant, and the Anaheim Fire Chief, or the Anaheim Fire Emergency Preparedness Division Chief, or the Anaheim Assistant City Manager, is hereby authorized and directed to execute any agreements, assurances or other documents as may be necessary in connection with the acceptance and administration of said Grant, as may be required by the Grantor, if Grant is awarded to the City. 4. The annual budget of the City of Anaheim for fiscal year 2008 -09 is hereby amended by increasing the appropriations and authorized expenditures in Program No. 213- 310 -2286 in such amount as is equal to the amount of Grant funds to be received by the City.
