RESOLUTION 2008 160
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF PUBLIC UTILITY
EASEMENT LOCATED AT 150 NORTH RIVERVIEW DRIVE
PURSUANT TO CALIFORNIA STREETS AND HIGHWAY
CODE SECTION 8330, ET SEQ. SUMMARY VACATION.
(Abandonment No. ABA 2008 00186)
WHEREAS, an applicant has requested the vacation of an easement for public utility
purposes located at 150 North Riverview Drive, Anaheim, California, because the original easement
which was approved prior to final design did not cover all of the public improvements and thereafter,
a new easement was dedicated on Parcel Map No. 2006 -222; and
WHEREAS, the public utility easement to be vacated is not necessary for present or
prospective public utility purposes; and
WHEREAS, the easement to be vacated is superseded by relocation of public utilities
and there are no other public facilities located within the easement; and
WHEREAS, the easement to be vacated has not been used for the purpose for which
it was dedicated or acquired for five consecutive years immediately preceding this proposed
vacation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the partial vacation of the easement for public utility purposes, as set
forth in an Easement Deed recorded August 27, 2007 as Instrument Number 2007000529290 of
Official Records, Orange County, State of California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 1 6th day of September 2008, by the following roll call vote:
AYES: Mayor Pringle, Council Members Hernandez, Sidhu, Galloway, Kring
