RESOLUTION 2008- 173
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING TWO PUBLIC UTILITY EASEMENTS
LOCATED AT 5455 EAST LA PALMA AVENUE PURSUANT
TO CALIFORNIA STREETS AND HIGHWAY CODE SECTION
8330, ET SEQ. SUMMARY VACATION. (Abandonment No.
ABA 2008 00192)
WHEREAS, an applicant has requested the vacation of two public utility easements
located at 5455 East La Palma Avenue, Anaheim California, in order to clear title to the parcel of
land, in order to remove existing electrical facilities; and
WHEREAS, the applicant has dedicated a replacement easement and is installing new
electrical facilities within the new easement area; and
WHEREAS, the public service easements to be vacated are not necessary for present
or prospective public utility purposes; and
WHEREAS, the easements to be vacated are superseded by relocation of public
utilities and there are no other public facilities located within the easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the two public utility easements, as set forth in two
Partnership Easement Deeds recorded on March 10, 1987 as Instrument Number 87- 129447 and
recorded on January 20, 1988 as Instrument Number 88- 027421 of Official Records, Orange County,
State of California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this -L4th day of OctohPr 2008, by the following roll call vote:
