A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING CONDITION NO. 3 OF RESOLUTION
NO. 77R-5 APPROVING RECLASSIFICATION NO.
76-77-2.
WHEREAS, the City Council of the City of Anaheim has
heretofore adopted Resolution No. 77R-5 finding and determining
that Title 18 of the Anaheim Municipal Code should be amended and
that the boundaries of certain zones should be changed as set
forth in Reclassification Proceedings No. 76-77-2; and
WHEREAS, the owner of the subject property has hereto-
fore requested that Condition No. 3 of Resolution No. 77R-5 be
amended; and
WHEREAS, the City Council hereby finds and determines
that the public interest and welfare necessitates the amendment of
Condition No. 3 of Resolution No. 77R-5 in the manner hereinafter
set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Condition No. 3 of Resolution No. 77R-5
approving Reclassification No. 76-77-2 be, and the same is hereby,
amended to read as follows:
'3. That the property owner(s) shall (a) grant a
minimum 30-foot wide ingress and egress easement
('easement') to the southeast portion of the parcel at
the southeast corner of Ball Road and Sunkist Street,
and said easement shall be reviewed and approved by the
City Attorney and then be recorded in the Office.of the
Orange County Recorder concurrently with final tract
map recordation, (b) remove that portion of the exist-
ing block wall currently preventing access across said
easement and replace the same with a six (6) foot high
access gate across said easement, and (c) post a bond
in a form approved by the City Attorney to guaranty the
removal of said wall within a period of five (5) years
from the date hereof."
BE IT FURTHER RESOLVED that, except as expressly amended
herein, said Resolution No. 77R-5 shall remain in full force and
effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council this 23rd day of May, 1978. ~
