1976-139RESOLUTION NO. 76R- 139 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON- MENT OF THAT PORTION OF CERTAIN PROPERTY DESCRIBED HEREIN. WHEREAS, the City Council of the City of Anaheim did, on the 9th day of March, 1976, by Resolution No. 76R-111, in connection with a request for vacation and abandonment of a portion of a public utility easement, located at the north side of Carleton Circle, west of Dwyer Drive, in the City of Anaheim, more fully hereinafter described, set the 30th day of March, 1976, at 2:30 o'clock P.M. for a public hearing thereon; and WHEREAS, on said 30th day of March, 1976, at 2:30 o'clock P.M. in the Council Chamber in the City Hall of the City of Anaheim, said public hearing was held; and WHEREAS, the City Council finds from the evidence sub- mitted at said public hearing that that portion of said public utility easement located at the north side of Carleton Circle, west of Dwyer Drive, in the City of Anaheim, as it may relate to the property described herein is unnecessary for present or prospective public utility purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds that said public hearing was properly held and that all notices were given and publica- tions made as required by law. 2. That that portion of the real property toward which a request for vacation and abandonment was directed is not necessary for present or prospec- tive public utility purposes and does hereby order that said portion, as herein set forth be, and it is hereby, vacated, abandoned and closed to public use. 3. That saidportion of real property herein ordered vacated, abandoned and closed to public use is situated in the City of Anaheim, County of Orange, State of California, and is more particularly de- scribed as follows, to wit: That portion of an existing public utility easement to be abandoned located in the City of Anaheim, County of Orange, State of California, described as follows: The Southwesterly five (5) feet of Lot H in Tract No. 14563, as shown on a map recorded in Book 48, page 20, Miscellaneous Maps, records of said Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of 75-9A the City of Anaheim, to be recorded in the Office of the County Recorder of Orange County, California.
