A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE DIRECTOR OF PUBLIC
WORKS OR DESIGNEE TO SUBMIT APPLICATIONS ON
BEHALF OF THE CITY OF ANAHEIM TO THE
DEPARTMENT OF RESOURCES RECYCLING AND
RECOVERY FOR PAYMENT PROGRAMS AND RELATED
AUTHORIZATIONS AND TO AUTHORIZE ACCEPTANCE
OF THE FUNDS IF AWARDED.
WHEREAS, pursuant to Public Resources Code sections 48000 et seq., 14581,
and 42023.1(g), the Department of Resources Recycling and Recovery ("CalRecycle") has
established various payment programs to make payments to qualifying jurisdictions; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures governing the administration of the payment programs; and
WHEREAS, CalRecycle's procedures for administering payment programs
require, among other things, an applicant's governing body to declare by resolution certain
authorizations related to the administration of the payment program; and
WHEREAS, the City of Anaheim ("City") desires to submit applications to
CalRecycle for any and all payment programs; and
WHEREAS, the City is familiar with the terms, conditions and limitations of
CalRecycle payment programs; and
WHEREAS, the City is willing and able to conform to each of the terms,
conditions and limitations imposed upon by CalRecycle.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Director of Public Works or designee is hereby authorized to submit
funding applications for and on behalf of the City of Anaheim, a public entity established under
the laws of the State of California, and to execute any documents and take any actions necessary
for the purpose of obtaining federal financial assistance provided by the Department of
Resources Recycling and Recovery.
2. The City Council of the City of Anaheim hereby agrees to, and by this
resolution, does accept any funding so awarded to the City of Anaheim without further action of
the City Council being required therefore.
3. The City of Anaheim hereby agrees to comply with each and all of the
terms, conditions and limitations imposed by CalRecycle upon said funds, and the Director of
Public Works or designee is hereby authorized and directed to execute any agreements,
assurances or other documents as may be necessary in connection with the acceptance of said
funds and required by CalRecycle, if such funds are awarded to the City.
BE IT FURTHER RESOLVED that these authorizations are effective until
rescinded by the City Council of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 1 7th day of May , 2016, by the following roll call vote:
