RES-2016-185RESOLUTION NO. 2016-185 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING A BEACH BOULEVARD ECONOMIC DEVELOPMENT INITIATIVE, DIRECTING STAFF TO ESTABLISH THE PROCESS TO IMPLEMENT THE INITIATIVE AND DETERMINING SAID ACTION IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO CEQA GUIDELINES SECTIONS 15060(c)(2) AND 15060(c)(3) AND NOT A PROJECT UNDER SECTION 15378. WHEREAS, the City of Anaheim has made a long-term commitment to economic development and the City seeks to focus efforts on the revitalization of the Beach Boulevard corridor in West Anaheim; and WHEREAS, the economic viability of this area depends upon a number of factors, including the City's ability to seek new investment that will help revitalize and alleviate physical and economic blight currently in existence; and WHEREAS, consistent with the above, the City desires to attract businesses that meet community priorities, as well as improve existing commercial businesses by establishing the Beach Boulevard Economic Development Initiative to support, on a case-by-case and as -needed basis, developers, businesses, and industries locating, expanding or remaining along Beach Boulevard; and WHEREAS, the City Council finds and determines that the implementation of the Beach Boulevard Economic Development Initiative is a municipal affair which is (i) consistent with the City's overall economic goals and strategies as well as certain goals and objectives of the City's General Plan, (ii) a matter of City-wide importance, (iii) necessary for the preservation and protection of the public health, safety and/or welfare of the surrounding community, and (iv) in accord with the public purposes and provisions of applicable State and local laws and requirements; and WHEREAS, the City Council finds and determines that the establishment of the Beach Boulevard Economic Development Initiative, by the adoption of this Resolution, is not subject to the California Environmental Quality Act of 1970, as amended (Public Resources Code Section 21000 et seq.; herein referred to as "CEQA"), pursuant to Sections 15060(c)(2) and 15060(c) (3) of the State of California Guidelines for Implementation of the California Environmental Quality Act (California Code of Regulations, Title 14, Chapter 3; herein referred to as the "CEQA Guidelines"), because it will not result in a direct or reasonably foreseeable physical change in the environment and is not a "project" as defined in Section 15378 of the CEQA Guidelines. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Beach Boulevard Economic Development Initiative is established to provide the following forms of economic development support for encouraging the attraction and retention of priority businesses and the development of preferred projects and uses as identified in the Beach Boulevard Specific Plan and through community outreach: 1) Developer Fee Deferrals 2) Developer Fee Waivers 3) Flexible Development Standards 4) Commercial Rehabilitation Loans 5) Economic Development Ombudsman BE IT FURTHER RESOLVED that the Directors of the Planning and Community & Economic Development Departments are directed to establish the process for participation in the Beach Boulevard Economic Development Initiative and the determination of the level of economic development support which will be recommended on a project -by -project and as -needed basis. It is the intent of the Initiative to customize the level of support to allow for maximum flexibility to better respond to the needs of the surrounding community. If, based upon this established process, there is a recommendation for economic development support which includes financial assistance, such terms will be memorialized in an agreement subject to the subsequent independent exercise of discretion by the City Council and in accordance with State and local laws and regulations.
