A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING EASEMENTS FOR SEWER AND
SIDEWALK PURPOSES, GENERALLY LOCATED AT 200
NORTH LEMON AVENUE PURSUANT TO CALIFORNIA
STREETS AND HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABA2016-00346)
WHEREAS, an applicant has requested the vacation of two easement for sewer and
sidewalk purposes generally located at 200 North Lemon Avenue, in the City of Anaheim, County of
Orange, State of California, as more particularly described below ("Easements"), in order to clear
title for the development of a four-story mixed use project consisting of 200 apartment units with
18,000 square feet of retail space, in conjunction with Tentative Parcel Map No. 2012-148; and
WHEREAS, the City of Anaheim ("City of Anaheim") acquired the Easements for
public purposes; and
WHEREAS, the Easements are not necessary for present or prospective public
purposes; and
WHEREAS, the Easements to be vacated are considered to be excess right of way,
have been superseded by relocation and there are no other public facilities located within the
Easements;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Anaheim does hereby order (1) the vacation of the easement for sewer and rights incidental thereto as
set forth in a document recorded in Book 195, Page 207 of Deeds, Official Records of Orange
County and more particularly described in Exhibit "A", and (2) the vacation of the easement for
sidewalk and rights incidental thereto as set forth in a document recorded in Book 108, Page 264 of
Deeds, Official Records of Orange County as more particularly described in Exhibit "A." Exhibit
"A" is attached hereto and incorporated by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized and
directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the Easements vacated shall no longer constitute easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 18thday of October , 2016, by the following roll call vote:
AYES: Mayor Tait and Council Members Kring, Murray, Brandman,
and Vanderbilt
