RES-2016-220RESOLUTION NO. 2016- 2 2 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING PERMIT PARKING DISTRICT NO. 57 ("GAYMONT LYNROSE") NEIGHBORHOOD AND DESIGNATING GAYMONT STREET FROM ROME AVENUE TO BALL ROAD, LYNROSE DRIVE FROM GAYMONT STREET TO BIRCHLEAF DRIVE, AND ELMLAWN DRIVE FROM GAYMONT STREET TO BIRCHLEAF DRIVE AS "PERMIT PARKING ONLY" STREETS AND DETERMINE THE ACTION IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO REGULATION NO. 15061(13)(3). WHEREAS, Section 14.32.450 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code authorizes the City Council to, by resolution, designate any streets, or portions thereof, as "Permit Parking Only" streets; and L WHEREAS, on August 7, 2007 the City Council approved a Council Policy relating to Permit Parking recommending that neighborhood residents work with Neighborhood Services District Teams in identifying solutions and that Permit parking be considered a solution of last resort to be will be considered only after other options have been evaluated and determined to be infeasible (the "Council Polity"); and WHEREAS, on December 15, 2015, the City Council approved an Ordinance to amend Municipal Code Section 14.32.450 to include multi -family neighborhoods in the permit parking policy; and WHEREAS, the Council Policy sets forth a process to create a Permit Parking District and establishing a process enabling individual streets within the identified District boundary to request implementation of permit parking; and WI IEREAS, the steps recommended in the Council Policy have been duly followed to establish a proposed Permit Parking District No. 57 and designating Gaymont Street from Rome Avenue to Ball Road, Lynrose Drive from Gaymont Street to Birchleaf Drive, and Elmlawn Drive from Gaymont Street to Birchleaf Drive "Permit Parking Only" in the areas described and depicted in attached Exhibit "A;" and WHEREAS, representatives of the community have met with the Neighborhood Services District Team and the Traffic and Transportation Manager, and efforts to identify and implement solutions to the parking other than permit parking have been determined to be insufficiently effective to resolve or significantly improve parking problems, so that no solution other than permit parking, appears to be feasible; and WHEREAS, the Police Department has performed field evaluation and determined that the criteria for.proceeding with consideration of a district exist; and WI?IEREAS, a survey was sent to determine if residents are in favor of implementing permit parking and a minimum 75% support rate among multi -family homes was achieved with a super majority of resident and owner surveys in favor of implementing permit parking in conformance with.the Council Policy; and WHEREAS, the City Council finds that the approval of the subject Permit Parking District is exempt from the California Environmental quality Act (CEQA) pursuant to Regulation No. 15061(b)(3), incorporated herein by this reference, which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment; and WHEREAS, the City Council wishes to establish a Permit Parking District No. 57; and WHEREAS, due to parking congestion on those streets herein set forth, the City Council hereby finds and determines that parking on Gaymont Street from Rome Avenue to Ball Road, Lynrose Drive from Gaymont Street to Birchleaf Drive, and Elmlawn Drive from Gaymont Street to Birchleaf Drive, as determined below, should be limited to persons possessing permits; and WHEREAS, the establishment of a "Permit Parking Only" areas on Gaymont Street from Rome Avende to Ball Road, Lynrose Drive from Gaymont Street to Birchleaf Drive, and Elmlawn Drive from Gaymont Street to Birchleaf Drive, as described below and as hereinafter set forth, is necessary. to enhance the public health, safety and welfare of the residents of the area, the users of the public streets and the public at large. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that Permit Parking District No. 57, and the same is hereby, established in the area depicted in attached Exhibit "A." BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that parking on the foll6wing City street segments, which are hereby designated as Permit Parking Area No. 57, shall be limited to those persons possessing a properly displayed valid parking permit: 1):' Gaymont Street from Rome Avenue to Ball Road, 2) Lynrose Drive from Gaymont Street to Birchleaf Drive, and 3) Elmlawn Drive from Gaymont Street to Birchleaf Drive. 2 Nothing contained in this resolution shall be construed to authorize parking or stopping where such parking or stopping is otherwise prohibited or to prohibit parking as it may otherwise be permitted by the California Vehicle Code or the Anaheim Municipal Code.
