A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING RESOLUTION NO. 2016-033
WHICH ESTABLISHED PERSONNEL RULES APPLICABLE
TO EMPLOYEES IN MANAGEMENT, CONFIDENTIAL,
AND NON -REPRESENTED PART-TIME
CLASSIFICATIONS
WHEREAS, the Human Resources Director has recommended in a staff report dated
January 24, 2017, that Resolution No. 2016-033 be amended in the manner hereinafter set fort effective
December 30, 2016; and
WHEREAS, as a result thereof, the need exists to amend Resolution No. 2016-033
which established Pay Polices and Rules for classifications designated as Management, Confidential,
and Non -Represented Part -Time;
WHEREAS, the City Council of the City of Anaheim does find that amending
Resolution No. 2016-033 is in the best interest of the City of Anaheim/
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim
amend Sections 1.2(b) and 1.2(c) of the Personnel Rules as follows:
Section 1.2 Scone
(b) The classifications of City Manager, City Attorney, City Clerk, City Treasurer,
Assistant City Manager, Deputy City Manager, Chief Policy Advisor to the Mayor,
Mayor Assistant, Senior Policy Aide, City Council Aide I, and City Council
Aide 11 are specifically exempted from the provisions of the Personnel System
by Anaheim Municipal Code (hereinafter, "AMC") Chapters 1.05.030.0102 and
1.05.030.0106. Employees appointed to a classification assigned to the Executive
Management Unit on or after January 1, 2016 are also exempt from the provisions
of the Personnel System by AMC Chapters 1.05.030.0102 and 1.05.030.0106.
Notwithstanding the provisions of Chapter 1.05.030.0102 and in accordance with
Chapter 1.050.030.030 of the AMC, unless otherwise specifically provided herein,
these Rules shall apply to employees in the classifications of City Manager,
Assistant City Manager, Deputy City Manager, City Attorney, City Clerk, City
Treasurer, Chief Policy Advisor to the Mayor, Mayor Assistant, Senior Policy
Aide, City Council Aide I, and City Council Aide 11 and to exempt employees
in classifications assigned to the Executive Management unit.
(c) At -Will Appointments
(1) The City Manager, City Attorney, City Clerk, and City Treasurer
shall serve at the pleasure of the City Council and may be removed from
their position(s) at any time and for any reason by majority vote of the
City Council, provided that such removal does not violate the Anaheim
City Charter or applicable law.
The Chief Policy Advisor to the Mayor, Mayor Assistant,
Senior Policy Aide, City Council Aide I, and City Council
Aide II are appointed on an "at -will" limited -term basis
aligned with the Mayor or Councilmember's elected term, and
may be removed from their position(s) at any time and for any
reason.
ii. "City Council Assistants" in accordance with Chapter
1.050.030.0106 of the AMC encompasses the Chief Policy
Advisor to the Mayor, Mayor Assistant, Senior Polices
City Council Aide I, and City Council Aide II classifications.
BE IT FURTHER RESOLVED that the effective date of this Resolution is December
30, 2016.
AND BE IT FURTHER RESOLVED that except as amended herein, Resolution 2016-
033 shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 24th day of January , 2017, by the following roll call vote:
