RES-2017-033RESOLUTION NO. 2017- 0 3 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING PERMIT PARKING DISTRICT NO. 58 ("GAIN") NEIGHBORHOOD AND DESIGNATING ARON STREET FROM ORANGE AVENUE TO ROVEN AVENUE, ROVEN AVENUE FROM ARON STREET TO GAIN STREET, GAIN STREET FROM BROADWAY TO ORANGE AVENUE, AND BEACHY PLACE FROM GAIN STREET TO THE END OF THE CUL-DE-SAC AS "PERMIT PARKING ONLY" STREETS AND DETERMINE THE ACTION IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO REGULATION NO. 15061(B)(3). WHEREAS, Section 14.32.450 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code authorizes the City Council to, by resolution, designate any streets, or portions thereof, as "Permit Parking Only" streets; and WHEREAS, City Council Policy Number 5.7 (the "Council Policy") sets forth a process to create a Permit -Eligible Parking District, and, following approval of the District, establishing a process enabling individual streets within the identified District boundary to request implementation of permit parking; and WHEREAS, on December 15, 2015, the City Council approved an Ordinance to amend Municipal Code Section 14.32.450 to include multi -family neighborhoods in the permit parking policy; and WHEREAS, the steps recommended in the Council Policy have been duly followed to designate as "Permit Parking Only" in the area described and depicted in attached Exhibit "A" which is incorporated herein by this reference; and WHEREAS, the steps recommended in the Council Policy have been duly followed to establish a proposed Permit Parking District No. 58 and designating Aron Street from Orange Avenue to Roven Avenue, Roven Avenue from Aron Street to Gain Street, Gain Street from Broadway to Orange Avenue, and Beachy Place from Gain Street to the end of the cul-de-sac "Permit Parking Only" in the areas described and depicted in attached Exhibit "A"; and WHEREAS, representatives of the community have met with the Neighborhood Services District Team and the Traffic and Transportation Manager, and efforts to identify and implement solutions to the parking other than permit parking have been determined to be insufficiently effective to resolve or significantly improve parking problems, so that no solution other than permit parking appears to be feasible; and WHEREAS, a survey was sent to determine if residents are in favor of designating in the areas described and depicted in attached Exhibit "A" as "Permit Parking Only," and a minimum support rate among single family homes was achieved in favor of establishing the "Permit Parking Only" street in conformance with the Council Policy; and WHEREAS, the City Council finds that the approval of the subject Permit Parking District is exempt from the California Environmental quality Act (CEQA) pursuant to Regulation No. 15061(b)(3), incorporated herein by this reference, which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment; and WHEREAS, the City Council wishes to establish a Permit Parking District No. 58; and WHEREAS, due to parking congestion on those streets herein set forth, the City Council hereby finds and determines that parking on the areas described and depicted in attached Exhibit "A" determined below, should be limited to persons possessing permits; and WHEREAS, the establishment of a "Permit Parking Only" areas on the areas described and depicted in attached Exhibit "A", as described below and as hereinafter set forth, is necessary to enhance the public health, safety and welfare of the residents of the area, the users of the public streets and the public at large. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that Permit Parking District No. 58, and the same is hereby, established in the area depicted in attached Exhibit "A." BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that parking on the following City street segments, which are hereby designated as Permit Parking Area No. 58, shall be limited to those persons possessing a properly displayed valid parking permit: 1) Aron Street from Orange Avenue to Roven Avenue, 2) Roven Avenue from Aron Street to Gain Street, and 3) Gain Street from Broadway to Orange Avenue, and 4) Beachy Place from Gain Street to the end of the cul-de-sac. 2 Nothing contained in this resolution shall be construed to authorize parking or stopping where such parking or stopping is otherwise prohibited or to prohibit parking as it may otherwise be permitted by the California Vehicle Code or the Anaheim Municipal Code.
