RES-2017-043RESOLUTION NO. 2017- 0 4 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE CLOSURE OF ALRO WAY EAST OF CLEMENTINE STREET IN ACCORDANCE WITH CALIFORNIA VEHICLE CODE SECTION 21101(A)(1) AND DETERMINE THE ACTION IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 15311 OF TITLE 14 OF THE CALIFORNIA CODE OF REGULATIONS WHEREAS, Vehicle Code section 21101(A)(1) authorizes the City Council by resolution to close any highway that is not needed for vehicular traffic; and WHEREAS, the proposed street closure will close Alro Way east of Clementine Street; and WHEREAS, on January 9, 2017 the Planning Commission approved Final Site Plan FSP2016-00006, Variance VAR2016-05077, and Administrative Adjustment ADJ2016-00389 (collectively "Entitlements") for the development of a 174 -room hotel located at 200 W Alro Way (the "Proposed Project"); and WHEREAS, Singod Investors VI, LLC and its successors would be required to improve and maintain the portion of Alro Way which are subject to the street closure, in accordance with the provisions of the Encroachment and Maintenance Agreement; and WHEREAS, Alro Way is a cul-de-sac street with a Hotel and vacant retail building to the south, a vacant lot to the north, a parking lot to the west, and I-5 Freeway to the east; and WHEREAS, the only vehicular traffic on Alro Way east of Clementine Street will be to/from the proposed project, Alro Way is not needed for thru or any adjacent parcel vehicular traffic; and WHEREAS, the Proposed Project is within that class of projects which consist of the construction or placement of minor structures accessory to existing commercial facilities, including small parking lots, and that, therefore, pursuant to Section 15311 of Title 14 of the California Code of Regulations, the Proposed Project will not cause a significant effect on the environment, and is, therefore, categorically exempt from the provisions of California Environmental Quality Act ("CEQA"). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it orders the closure of Alro Way lying east of Clementine Street, pursuant to California Vehicle Code Section 21101(a)(1) on the basis that it is no longer needed for vehicular traffic, as further set forth above and RESERVING THEREFROM vehicular access rights in favor of 200 and 205 West Alro Way and 1640 South Clementine Street.
