A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE DIRECTOR OF PUBLIC WORKS OR
HIS DESIGNEE TO SUBMIT A GRANT APPLICATION ON BEHALF
OF THE CITY OF ANAHEIM TO THE COUNTY OF ORANGE FOR
GRANT FUNDING FOR THE REGIONAL RECYCLING AND WASTE
DIVERSION PROGRAMS AND IF AWARDED AUTHORIZING THE
ACCEPTANCE OF SUCH GRANT ON BEHALF OF THE CITY AND
AMENDING THE BUDGET FOR FISCAL YEARS ACCORDINGLY
WHEREAS, the County of Orange ("Grantor") authorizes OC Waste & Recycling
to administer various Grant Programs in furtherance of the State of California's (State)
efforts to reduce, recycle and reuse solid waste generated in the State thereby preserving
landfill capacity and protecting public health and safety and the environment
("Grant(s)"); and
WHEREAS, in furtherance of this authority, the County of Orange, OC Waste &
Recycling is required to establish procedures governing the application, awarding, and
management of the Grant(s); and
WHEREAS, the City of Anaheim ("City") desires to submit applications to OC
Waste & Recycling for all Grant(s) for which the City of Anaheim is eligible; and
WHEREAS, if awarded, the City will enter into a Grant Agreement with the
County of Orange, OC Waste & Recycling for implementation of said Grant(s); and
WHEREAS, if awarded this authorization is effective from May 23, 2017 through
May 23, 2022; and
WHEREAS, the City is familiar with the terms, conditions and limitations of any
such Grant(s); and
WHEREAS, the City desire to accept any such Grant(s) which may be awarded to
the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Public Works Director or designee is hereby authorized to
submit funding applications for and on behalf of the City of Anaheim, a public
entity established under the laws of the State of California, and to execute any
documents and take any actions necessary for the purpose of obtaining
financial assistance provided by the Grantor and is hereby authorized and
directed to execute all Grant documents, including but not limited to,
applications, agreements, amendments and requests for payment, as may be
necessary to secure Grant funds and implement the approved Grant project.
2. The City Council of the City of Anaheim hereby agrees to, and by
this resolution, does accept any such Grant(s) so awarded to the City of
Anaheim without further action of the City Council being required therefore.
3. The City of Anaheim hereby agrees to comply with each and all of
the terms conditions and limitations imposed by OC Waste and Recycling
upon said Grants and the Anaheim Public Works Director or designee is
hereby authorized and directed to execute any agreements assurances or other
documents as may be necessary in connection with the acceptance of said
Grant as may be required by the Grantor if such Grant(s) is awarded to the
City.
4. Contingent upon the award of said Grant(s), the annual budget of
the City of Anaheim for each corresponding fiscal year will be amended
accordingly by increasing revenue and expenditures in an amount equal to the
amount of Grant funds to be received by the City.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 23rd day of May, 2017 by the following roll call vote.
AYES: Mayor Pro Tem Vanderbilt and Council Members Murray,
Barnes, Moreno, and Faessel
NOES: None
ABSENT: Council Member Kring
ABSTAIN: Mayor Tait
