2057ORDINANCE NO. 2057 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 1078 --Series 1963-64 in Reclassification No. 63-64-69, recom- mending an amendment to Title 18 of the Anaheim Municipal Code and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, as they apply to Parcel "A" only, recommending denial of a change in the boundaries of the zone or zones as they apply to Parcel "B," after having held a public hearing thereon in the manner and as prescribed in said Title 18 of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission did make findings and summaries of its hearing and did recommend a change or changes of zone or zones as set forth in said resolution; and WHEREAS, upon receipt of said resolution, report of findings, summary of evidence and recommendation of the City Planning Commission, the City Clerk did fix the 7th day of April, 1964, as the time, and the Council Chamber in the City Hall of the City of Anaheim as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Munici- pal Code and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports, and did thereupon consider the recommendation of the City Planning Commission, and did adopt Resolution No. 64R-245, finding and determining that Title 18 of the Anaheim Municipal Code should be amended and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolu- tion; and WHEREAS, in accordance with said Resolution No. 64R-245, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: 63-64-69 !M SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to Wit: Parcel "A": Westerly 283.00 feet of Lot 27 of Anaheim Investment Company s Tract, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 7, pages 33 & 34 of Miscellaneous Maps in the office of the County Recorder of said County. EXCEPT the Southerly 250.00 feet. Parcel "B"• Lot 27 of the Anaheim Investment Company's Tract, in the City of Anaheim, County of Orange, State of California, as per Map recorded in Book 7, Pages 33 & 34 of Miscellaneous Maps in the office of the County Recorder of said County. EXCEPT the Westerly 283.00 feet of said Lot 27. now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in the following zones, upon the conditions hereinafter set forth: That Parcel "A" above described shall be changed to and incorporated in C-0, COMMERCIAL OFFICE ZONE; and That Parcel "B" above described shall be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE. That Parcel "A" shall be changed to C-0, COMMERCIAL OFFICE ZONE, upon theFoollowing conditions: 1. That the existing palm trees shall be lowered, if, in the opinion of the Superintendent of Parkway Maintenance, the trees are dangerously undercut by the construction of the required improvements. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 3. That Parcel "A" shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit No. 1." -2- That Parcel "B" shall be changed to R-3, MULTIPLE -FAMILY RESI- DENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. 4. That the existing palm trees shall be lowered, if, in the opinion of the Superintendent of Parkway Maintenance, the trees are dangerously undercut by the construction of the required improvements. 5. That Parcel "B" shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1 through 5, approved by the City Council on April 7, 1964, and signed by the Mayor. 6. That parking area shall be provided in accordance with the provisions of the Anaheim Municipal Code. 7. That the Euclid Street and Palm Lane frontages of subject property shall be landscaped and said land- scaping maintained as indicated on Exhibit No. 1; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force. -3- • • THE FOREGOING ORDINANCE is approved and signed by me this 27th day of October , 1964 ATTEST: CITY\CLERK OF THE CITYOF ANAHEIM STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss.
