RES-2017-143RESOLUTION NO. 2017-143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CITY MANAGER TO ENTER INTO CERTAIN AGREEMENTS FOR AND ON BEHALF OF THE CITY WHEN THE AMOUNT DOES NOT EXCEED $50,000-00 DOLLARS AND DIRECTING STAFF TO AMEND COUNCIL POLICY 4.1 AS NECESSARY TO RELFECT THIS AUTHORITY. WHEREAS, Section 518 of Title V of the Charter of the City of Anaheim provides that, by ordinance or resolution, the City Council may authorize the City Manager to bind the City, with or without a written contract, for the acquisition of equipment, materials, supplies, labor, services or other items included within the budget approved by the City Council, and may impose a monetary limit upon such authority; and WHEREAS, pursuant to Section 518 of Title V of the Charter of the City of Anaheim, the City Council, by Resolution No. 2010-195 granted authority to the City Manager to enter into and amend agreements, so long as the total compensation payable under any agreement does not exceed the sum of $250,000.00; and WHEREAS, pursuant to Section 518 of Title V of the Charter of the City of Anaheim, the City Council, by Resolution No. 2011-157 rescinded Resolution No. 2010-095 and reduced the contractual authority of the City Manager to $100,000.00; and WHEREAS, pursuant to Section 518 of Title V of the Charter of the City of Anaheim, the City Council, by Resolution No. 2017-048, rescinded Resolution No. 2011-157 and reduced the contractual authority of the City Manager to $50,000.00; and WHEREAS, Resolution No. 2017-048 contains a "sunset clause" providing that it will expire six (6) months after its adoption, thereby necessitating that the City Council adopt a new resolution setting the amount of the City Manager's contractual authority; and WHEREAS, in the six months since Resolution No. 2017-048 was approved, four (4) agreements valued at between $50,000 and $100,000 have been presented to the City Council for approval; and WHEREAS, pursuant to Section 518 of Title V of the Charter of the City of Anaheim, the City Council desires to set the contractual authority of the City Manager at $ 50,000.00 , such that the City Manager shall have authority to enter into and amend agreements as provided herein so long as the total compensation payable under any such agreement does not exceed the sum of $ 50,000.00 ; and WHEREAS, Council further desires to direct staff to amend Council Policy 4.1 as necessary to reflect the authority conveyed to the City Manager by this resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby authorize the City Manager to enter into and amend agreements for the acquisition of equipment, materials, supplies, labor, services or other items, as well as the authority to enter into and amend memorandums of understanding, operational, cooperative, reimbursement, hold harmless, indemnification and similar agreements, for which funds are available within the budget approved by the City Council, provided the total compensation payable under any agreement, or amendment thereto, does not exceed the sum of $ 5 0 , 0 0 0.0 0 . This resolution does not encompass contracts entered into with individuals or entities performing services that would otherwise be performed by individuals serving in one of the following four job classifications, where the authority of the City Manager shall remain at 100,000.00: City Council Aide I, City Council Aide II, Sr. Policy Aide and Chief Policy Advisor to the Mayor. BE IT FURTHER RESOLVED that Staff is directed to amend Council Policy 4.1 as necessary to reflect the authority conveyed to the City Manager by this resolution. BE IT ADDITIONALLY RESOLVED that the authority granted herein shall not apply to Public Works agreements entered into pursuant to City of Anaheim Charter Section 1211.
