RESOLUTION 2017- 170
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING EASEMENT FOR PUBLIC UTILITY
AND PUBLIC PURPOSES PURSUANT TO CALIFORNIA
STREETS AND HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABA2017-00359)
WHEREAS, an applicant has requested the vacation of various easements for public
utility and public purposes generally located in the City of Anaheim, County of Orange, State of
California, as more particularly described below ("Public Service Easements"), in conjunction with
the development known as "La Palma Village;" and
WHEREAS, the City of Anaheim ("City of Anaheim") acquired the Public Service
Easements for various public purposes; and
WHEREAS, the public utility Easements to be vacated have been superseded by
relocation and there are no other public facilities located within the Public Service Easements; and
WHEREAS, the Public Service Easements are not necessary for present or
prospective Public Utility Purposes or any other public purpose; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the Public Service Easements as described in Exhibit "A"
attached hereto and incorporated by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized and
directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the Public Service Easements vacated shall no longer constitute a public service
easement
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 5th day of December , 2017, by the following roll call vote:
AYES: Mayor Pro Tem Vanderbilt and Council Members Murray,
Barnes, Moreno, Kring and Faessel
NOES: None
ABSENT: None
ABSTAIN: Mayor Tait

as follows:
That certain portion of an easement for overhang power lines, recorded March 8, 1962 in
Book 6032, Page 904 of Official Records of Orange County, Califomia, lying within the
boundaries of "Parcel 1" as shown on a map recorded June 22, 1982 in Book 171, Pages
32 and 33 of Parcel Maps of said County; and
An easement for water vault and related equipment, recorded November 28,1972 in Book
10444, Page 855 of Official Records of Orange County, California; and
An easement for public utility, underground conductors, conduits, vaults and transformer,
recorded September 11, 1979 in Book 13304, Page 1955 of Official Records of Orange
County, California; and
An easement for public utility, electrical facilities, ingress and egress, recorded on
November 2, 1982 as Instrument No. 82-385599 of Official Records of Orange County;
and
An easement for construction, ingress and egress for installation and construction of
storm drain facilities, recorded on May 22, 1991 as Instrument No. 91-250787 of Official
Records of Orange County; and
An easement for public utilities in favor of the City of Anaheim for existing electric and
water facilities as reserved in two Quitclaim Deeds, recorded April 29, 2016 as Instrument
No. 2016-000191552, and re-recorded August 24, 2016 as Instrument No.
2016000401695 of Official Records of Orange County
