RES-2017-186RESOLUTION 017NO. 7-186 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING CERTAIN FEES IN CONNECTION WITH PROCESSING BUSINESS LICENSE APPLICATIONS UNDER TITLE 3 OF THE ANAHEIM MUNICIPAL CODE. WHEREAS, by the adoption of Ordinance No. 5368 on May 18, 1993, the City Council enacted Title 3 of the Anaheim Municipal Code, which provide for the imposition and collection of a business license tax on persons for the privilege of transacting and carrying on any business, trade, profession, calling and occupation specified in Title 3; and WHEREAS, said Ordinance was enacted solely to raise revenue for municipal purposes; and WHEREAS, Section 3.04.145 (Application Processing Charge) and Section 3.04.180 (Duplicate License) of Title 3 of the Anaheim Municipal Code authorize the City to charge fees for the processing of initial or renewed business license applications and for issuing duplicate business licenses to replace previously issued business licenses which have been lost or destroyed (collectively referred to herein as the "Processing Fees"), which Processing Fees shall be in such amounts as may be established from time to time by resolution of the City Council; and WHEREAS, as mandated by State law, the City of Anaheim currently collects an additional fee of $1.00 from applicants for a business license, or renewal thereof, which is used to fund the State Certified Access Specialist (CASp) Program in order to increase the availability of CASp services and improve compliance with state and federal construction -related accessibility standards; and WHEREAS, on October 11, 2017, the Governor approved Assembly Bill No. 1379, which increased the State -mandated CASp fee from $1.00 to $4.00 and requires the City to collect this additional fee on and after January 1, 2018; and WHEREAS, the City Council further finds and determines that this Resolution establishing and/or amending the fees for the processing, analyzing and acting upon business license applications in the manner hereinafter set forth is exempt from the provisions of the California Environmental Quality Act pursuant to Section 21080 (b) (8) of the California Public Resources Code in that said fees are established to meet operating expenses, including employee wage rates and fringe benefits and purchasing or leasing of supplies, equipment, materials and services; and WHEREAS, this City Council desires to increase the amounts of the Processing Fees that have heretofore been in effect, which increased amounts do not exceed the cost of providing the business license processing services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM AS FOLLOWS: Section 1. The foregoing recitals are true and correct. Section 2. The following Processing Fees for the business license services provided by the City under Section 3.04.145 (Application Processing Charge) and Section 3.04.180 (Duplicate License) of Title 3 of the Anaheim Municipal Code are hereby adopted and shall be and become effective as of, on and after January 1, 2018: Initial Period Application Processing Fee $35.00 Renewal Application Processing Fee $35.00 Duplicate Business License Fee $35.00 Section 3. The amounts of said Processing Fees are less than or equal to, but in any event do not exceed, the actual direct and indirect costs and expenses incurred by the City of Anaheim in receiving, processing, analyzing and acting upon business license applications. Section 4. Pursuant to Chapter 3.04 (General Provisions) of Title 3 of the Anaheim Municipal Code the Collector is hereby authorized and directed to collect said Processing Fees for and on behalf of the City of Anaheim.
