2050Planning - 21 ORDINANCE NO. 2050 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 1, CHAPTER 1.042 SECTION 1.04.370(c) OF THE ANAHEIM MUNICIPAL CODE RELATING TO OFFICERS AND DEPARTMENTS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, under the terms of the new City Charter of the City of Anaheim adopted by the voters and to become the law of the City of Anaheim on ratification by the State Legis- lature, the number of planning commissioners was established at the number of seven; and WHEREAS, the present authorization of planning com- missioners is seven members but there are regwired five members to constitute a _quorum for the transaction of business; and WHEREAS, the requirement of five members for a quorum existed in contemplation of the authorization of nine members for the Planning Commission; and WHEREAS, it would be in the best interests of the City to change immediately the number required for a quorum from five to a majority of the members of the Planning Com- mission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 1, Chapter 1.04, Section 1.04, 370(c) of the Anaheim Municipal Code be and the same is hereby amended to read as follows: 111.04.370(c) "The Planning Commission shall hold at least one re- gular meeting each month and such additional meetings as it deems advisable and shall keep a record of its resolutions, transactions, findings and determina- tions, which record shall be a public record.* A majority of the total voting members of the Planning Commission shall constitute a quorum for the trans- action of business. The adoption, amendment, extension or addition to a master or general plan, or the recommendation of, or any amendment to, any precise plan or regulation shall be by resolution of the Commission carried by the affirmative vote of not less than a majority of its total voting members." SECTION 2. This ordinance is hereby declared to be an urgency measure and shall be in full force and effect immediately upon its adoption. The facts constituting such urgency are as follows: -1- C7 The provisions of the Charter,of the City, which will go into full force and effect the first part of 1965, will immediately reduce the number of Planning Commissioners -from nine to seven and make no specific provision for the number required for a quorum. The original requirement of five members for a quorum as provided by the Anaheim Municipal Code was enacted in contemplation of a total membership of nine Planning Commissioners. Section 1.04.350 of the Anaheim Municipal Code now provides for a total membership of seven for the Planning Commission. Since seven members are now appointed and constitute the Planning Commission, it becomes more difficult to obtain a quorum of five members and effectively transact the business of the Planning Commission. It is, there- fore, desirable to change the required number of commissioners for a quorum from five to a majority of the present membership. The change of such number will properly provide for the orderly transaction of the business of the -Planning Commission and will be in the best interests of the City of Anaheim and the citi- zens thereof. The adoption of this ordinance as an urgency measure is necessary for the immediate preservation of the public peace, health, safety and public welfare. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and immediately upon and after its passage it shall take effect and be in full force.
