2038Planning Acctg. Off. ORDINANCE NO. 2038 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 1, CHAPTER 1.041, SECTION 1.04.350 OF THE ANAHEIM MUNICIPAL CODE RELATING TO OFFICERS AND DEPARTMENTS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, under the terms of the new City Charter of the City of Anaheim adopted by the voters and to become the law of the City of Anaheim on ratification by the State Legis- lature, the number of planning commissioners was established at the number of seven; and WHEREAS, the present authorization of planning commissioners is nine but there are in fact only seven persons appointed and acting as planning commissioners; and WHEREAS, it would be in the best interests of the City to immediately change the number of planning commissioners from nine to seven. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 1, Chapter 1.04, Section 1.04.350 of the Anaheim Municipal Code be and the same is hereby amended to read as follows: 1°1.04.350 PLANNING COMMISSION CREATED. "There is hereby created a Planning Commission for the City of Anaheim, which Planning Commission shall consist of seven members appointed by the City Council of the City of Anaheim." SECTION 2. This ordinance is hereby declared to be an urgency measure and shall be in full force and effect immediately upon its adoption. The facts constituting such urgency are as follows: Since the provisions of the Charter of the City which will go into full force and effect the first part of 1965, will immediately reduce the number of planning commissioners from nine to seven, and since there are presently only seven members of the nine authorized which have been appointed and • are acting as planning commissioners, it would require the immediate appointment of two Planning Commission members who could only serve for a short period until the number is reduced by the ratification of the Charter. It would appear a useless -1- act to appoint two members which would then a very short • period later require the dismissal of two members from the Planning Commission and thus cause a certain disruption in the orderly process of the Planning Commission's functions. Since there presently are authorized nine members of the Planning Commission with only seven members appointed and acting, it becomes more difficult to obtain a quorum and the transaction of business and it is therefore desirable to change the authorized number of planning commissioners from nine to seven. The change of the number of planning commis- sioners authorized from nine to seven will properly provide for the orderly transaction of the Planning Commission business and will be in the best interests of the City of Anaheim and the citizens thereof. • The adoption of this ordinance as an urgency measure is necessary for the immediate preservation of the public peace, health, safety and public welfare. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and immediately upon and after its passage it shall take effect and be in full force.
