20040— ORDINANCE NO o 2004 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELAT- ING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 569 -- Series 1962-63 in Reclassification No. 62-63-35 , recommending an amendment of Title 18 of the An ei.m Municipal— Code and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a pudic hearing thereon in the manner and as prescribed in said Title 18 of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission did make find- ings and summaries of its hearings and did recommend a change or changes of zone or zones as set forth in said resolution; and WHEREAS, upon receipt of said resolution, report of findings, summary, of evidence and recommendation of the City Planning Commission, the City Clerk did fix the 5th day of February , 19 63 , as the time, and t Coouxncil C amier in -the City Ham—ihe City of Anaheim as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and dial give notice thereof in the manner and as provided in said Title 1.8 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and dial receive evidence and reports, and did there- upon consider the recommendation of the City Planning Commission, and dial adopt Resolution 2s) No. (s) 63R-97 , finding ani determining that Title 18 of the 7EMeim Municipa Code should be amennded and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolu- tion(s); and WHEREAS, in accordance with said Resolution(s) 63R-97 certain conditions and requirements were made as con it!ons precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOW, WHEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as followso 1 - 62-63-35 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the Northeast quarter of the Northeast quarter of Section 15, in Township 4 South, Range 11 . West, San Bernardino Base and Meridian, described as follows: Beginning at a point in the East line of said Section 15, 344 feet North of the Southeast corner of the North- east quarter of the Northeast quarter of said Section 15, running thence West 630 feet to a point; thence North parallel with the East line of said Northeast quarter of the Northeast quarter, 328 feet; thence East parallel with the South line of said Northeast quarter of the Northeast quarter, 630 feet to a point in the East line thereof and thence South along said East line 328 feet to the point of beginning; now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 2. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 3. That subject property shall be developed substan- tially in accordance with plans on file with the City, marked "Revision No. 2, Exhibits Nos. 1, 21 3, and 4," approved by the City Council May 19, 1964. 4. That the interior walls of the proposed carports shall be stuccoed; that enclosed storage cabinets shall be installed along the rear wall of said car- ports; that auto bumper guards shall be installed near the rear wall of said carports; and that all of said items shall be completed prior to final building inspection. 5. That a 6 -foot masonry wall shall be constructed along the north boundary of subject property as in- dicated on the plans marked "Revision No. 1, Exhibit No. 1," on file with the City of Anaheim. SECTION 2. The City Zoning Map shall be, and the same is hereby, 10 amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said -2- City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
