RESOLUTION 2018- 029
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING PUBLIC UTILITY
EASEMENTS PURSUANT TO CALIFORNIA STREETS
AND HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABA2017-00364)
WHEREAS, an applicant has requested the vacation of various public utility
easements generally located at 1030 West Katella Avenue, in the City of Anaheim, County of
Orange, State of California, as more particularly described below ("Public Service Easements"),
in conjunction with the development of a new hotel; and
WHEREAS, the City of Anaheim ("City of Anaheim") acquired the Public
Service Easements for public utility purposes ("Public Utility Purposes"); and
WHEREAS, the Public Service Easements are not necessary for present or
prospective Public Utility Purposes or any other public purpose; and
WHEREAS, the Public Service Easements to be vacated have been superseded by
relocation and there are no other public facilities located within the Public Service Easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the Public Service Easements as described in
Exhibits "A" and "B" attached hereto and incorporated by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim
hereby makes this vacation pursuant to the requirements of the California Streets and Highways
Code, Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution
shall not be effective until a certified copy of this Resolution is recorded in the Office of the
Recorder of the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the
Recorder of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of
this Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation
shall be complete and the Public Service Easements vacated shall no longer constitute public
service easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 27th Day of March , 2018 by the following roll call
vote:
AYES:Mayor Tait and Council Members Moreno, Murray, Vanderbilt,
Barnes, Kring, and Faessel

LEGAL DESCRIPTION
In the City of Anaheim, County of Orange, State of California, being that certain easement for the
installation and maintenance of underground conductors, conduits, structures, padmount
transformers and related electrical facilities purposes as described in the Corporation Easement
Deed recorded July 21, 1981 in Book 14149, Page 324, and that certain non-exclusive easement for
the installation and maintenance of electrical facilities, including underground wires, cables, vaults
and related facilities as described in the Easement Deed recorded October 31, 2000 as Instrument
No. 20000587224 and recorded January 23, 2002 as instrument no. 20020060201, and that certain
easement for the installation and maintenance of electrical underground wires, cables and related
facilities as described in a Corporation Easement Deed recorded June 5, 1981 in Book 13902, Page
1414, all of Official Records.
Subject to covenants, conditions, reservations, restrictions, rights of way and easements of record, if
any.
As shown on Exhibit "B" attached hereto and by this reference made a part hereof.
