The regular meeting of July 11, 2017 was called to order at 3:10 P.M. in the chambers of
Anaheim City Hall, located at 200 S. Anaheim Boulevard. The meeting notice, agenda, and
related materials were duly posted on July 7, 2017.

R. Joshua Collins, Homeless Advocates for Christ, commented on the City's anti -camping
ordinance and expressed concerns with the seizure of homeless individuals' property. He
encouraged Council totarget criminal aotivitv, not life-sustaining activity.
Mary Lou Sitter spoke in opposition to repealing the anti -camping ordinance and expressed
concerns with decreased property values, public safety, crime, drugs and debris, and suggested
faith -based organizations step upand help the homeless.
G\O[iB H@\G spoke regarding funding for the Anaheim Hills Fourth of July event and its euccems,
thanked Council for attending and participating in the parade, and thanked staff and the City for
its support.

Trevor O'Neil spoke in opposition tooutsourcing the Anaheim Fire Service to the Orange County
Fire Authority (OCFA)(item No. 19). He reported the Anaheim Fire Department's response time
inbetter than the [)CFAby14Y6.has innovative new programs, operates the JPA for the Q11 Fire
Dispatch from multiple municipalities, iGanISO Class 1 Fire Department, and having acity Fire
Department saves money for residents oninsurance rates.
VViUiarn Fitzgerald, Home [)vvneno Maintaining Our Environment, addressed the hanging of
rainbow banner on the outside of City Hall and added Council was dishonoring those who died for
the country serving iOthe Army, Rainbow Infantry Division.
Mayor Tait addressed Mr. Fi1zgena|d'acomments asoutrageous but acknowledged
people have the right to free speech in this country.
Julie Brunette acknowledged the speaker's disrespect and, inresponse to her question, Mayor
Tait reported Council asks that people be respectful,but cannot legally require it. Ms. Burnett
reported she was almost homeless and has compassion, but nopity.
Diana Kotler, Executive Director, Anaheim Resort Transportation Network, reported they
transport approximately 9 million passengers every year, will soon have 23 routes and a fleet of
over 80 buses, and have added zero -emission, clean -burning fuel vehicles to the fleet. She
announced a celebration of 15 years serving the City and reported they will offer free service,
every Friday, to Anaheim residents beginning Friday, July 15, 2017 and will continue for the
remainder ofthe year. Ms. Cutler reported they also serve destinations inOrange County and
thanked the City for its support.
Ron Bengochea referenced Item No. 09, suggesting Council consider extending the term nfthe
contract from six months to one year and spoke positively regarding the present provider,
Superior Property Services, Inc., noting they offer excellent service. |nterms nfItem No. 19. he
urged Council to keep the Anaheim Fire []epartmnent, not outsource, and commented positively
on their service.
Renee B. addressed office pinvo|vedshootings and stated her belief that there was no
accountability within the Police Department. She urged the public bJfilm encounters with
Anaheim Police Officers, commented on former City Manager Paul Emery's actions against
Yesenia Rojas, and announced a c-ampout for the homeless on July 14, 2017, at the front gates
toDisneyland, from A:DOP.K8. to3:OOA.M. and encouraged the public toattend.
Lou Noble addressed comments about homelessness, spoke insupport ofA|Fresco Gardenm,
and urged Council torepeal the property confiscation portion Vfthe anti -camping ordinance. He
noted shelters are full, the City has no affordable housing available, and women and children are
living in their cars.
yWehannV1aoi|er' representing the neighborhood onWest Crohn Avenue between Gi|book and
Walnut, expressed concerns with increased traffic and disregard for the posted speed limit by
drivers using Crohn asoohoht-cut. She referenced results ofatraffic study conducted last year,
but reported nothing was done, adding she has submitted a petition requesting a traffic -calming
study and hoped itwill yield results. She suggested one solution could include blocking the street
off, atWalnut orinstalling speed bumps Locurtail speeding.
"The Cameraman" commented on funding the Anaheim Hills Fourth of July Parade compared to
the use of illegal fireworks in West Anaheim, stated people are more likely to be killed by the
police than by 8 hmnle|eoe paraom, added the homeless were not affecting property values in his
neighborhood, and noted there was a difference between prostitution and homelessness.

Russell Rutherford commented on homeless people living on the Santa Ana Riverbed and other
areas of the City with concerns about public safety and flooding and urged Council to do
something about it.
Eve Garrow, ACLU, spoke in opposition to the removal of benches at some City bus stops and
stated the poiioy, along with the anti -camping ordinance, were designed todeter people
experiencing homelessness from o|8apinQ or resting in public places. She alleged the City was
responding by making life harder for homeless individuals, expressed concern that the newly -
designed bus stops may not follow ADA regulations, and urged Council to reconsider the anti -
homeless policies and do more toend homelessness and take a leadership role in urging the
County Board of Supervisors to form its own ten-year plan and end homelessness using a
"Housing First" nlOdo|.
Juan Maldonado asked regarding expansion of Anaheim Coves and commented on the benefits
of investing in sports and pnDrnot{OQ healthy -living.
Nancy West distributed copies of an email she sent to Council Member Kring and reported Al
Fresco Gardens was not a homeless camp, but rather an outdoor living community with amourib/,
police access, visiting Greao, and outreach services. She stated she was not against the anti -
camping ordinance but felt it does not make sense until people have o place to go and
CorDnlmOted on services provided byCityNetand their claimed retention rate.
Denise VVhir|adgedistributed copies ofpictures, illustrating the homeless pnDb|enn and related
crimes. She expressed concerns about noise, screaming, and homeless people defecating near
her backyard. She urged Council to work with the County to do something about the problem, as
the homeless aowell 8aresidents need help.
Mayor Tait asked Interim City K88nogerAOd@| for repod, at the next C/h/ Council
meeting regarding jurisdictional issues with the County iDterms ofsolving the
homeless issue.
Miriam Avery thanked Council Members Kring and Murray for voting in favor of the anti -camping
ordinance and for their support, She commented oMthe City's parks but stated she does not feel
safe allowing her children to play there because the naetnJomaape not clean and are littered with
used syringes,
Richard Rodriguez stated the debris and syringes may not beall related to homeless peoples, as
they are not allowed inparks. Heread astatement ofproperty rights msahomeless person.
Bryan Kaye reported receiving g letter from the City Attorney, in response to over 50 or more
requests from him, and noted hehas not received any from Council. Healleged the Anaheim
Police have called him names and claimed heresisted arrest.
Rosa |oelaLopez spoke about the need hosolve the homeless problem inthe City and the need
for affordable housing.
An,a|e speaker expressed concerns with people using illegal fireworks during the Fourth of July,
not having access to his house because of the number of people in the streets, and asked for
clarification regarding the City's policies relative tVfireworks. AdditionoUy, he commented on the
homeless issue and suggested the City provide asubsidy tohomeless people touse hotels
having excess capacity.

COUNCIL COMMUNICATIONS/AGENDA REQUESTS: None
CITY MANAGER'S UPDATE:
Interim City Manager Linda Andal requested the Mayor's request for a report regarding
jurisdictional issues with the County regarding the homeless along the Santa Ana River and flood
control channels be set for the August 15, 2017 Council meeting to follow an August 1st meeting
between the Police Department and Orange County Sherriff's Department, with no objection by
Council.
At 7:38 P.M., City Council was adjourned to consider the Housing Authority agenda, reconvening
at 8:13 P.M.
CONSENT CALENDAR: Council Member Kring removed Item No. 09 from the Consent
Calendar for separate discussion and Mayor Tait declared a potential conflict on Items No. 11
and 14.
MOTION: Council Member Kring moved to waive reading in full of all ordinances and resolutions
and adopt the Consent Calendar as presented, in accordance with reports, certifications and
recommendations furnished each City Council Member and as listed on the consent calendar,

D180 5. Accept the bids of BHC Crane, LLC, Hill Crane Service, Inc. and Mr. Crane, Inc., in a
combined amount not to exceed $75,000, for crane rental services on an as -needed
basis for a one-year period with four one-year optional renewals and authorize the
Purchasing Agent to exercise the renewal options in accordance with Bid #8906.
D180 6. Accept the bid from Waxie Sanitary Supply, in the amount of $112,131.21 plus applicable
tax, and the bid from Verativ Corp., in the amount of $245,393.95 plus applicable tax, for
custodial equipment and trash receptacles for use in the expanded Anaheim Convention
Center and authorize the Purchasing Agent to issue the purchase orders in accordance
with Bid #8964.
D180 7. Waive the sealed bid requirement of Council Policy 4.0 and authorize the extension of the
master agreement with Aramark Services Inc. extending the term retroactive from April
30, 2017 through December 31, 2017 and increasing the contract amount by $28,000 to
a total not to exceed amount of $48,000, for the furnishing of meals at the Anaheim
Police Department detention facility.
AGR- 8. Waive the sealed bid requirement of Council Policy 4.0 and approve an agreement with
2779.A Unique Management Services, Inc., in the approximate amount of $10,000 per year, for
assistance in library material and fine recovery for a three-year term with two one-year
optional renewals.

AGR- 10. Approve Professional Services Agreements with two consulting firms, Civic Solutions, Inc.
10642 and MIG, Inc., each in the amount of $300,000, for planning services on an as -needed
basis to support the Planning Services Division of the Planning and Building Department
for a two-year term with up to three one-year optional extensions for a maximum five-year
term.
AGR- 11, Approve an agreement with the Orange County Fire Authority (OCFA) allowing the
1784.A Anaheim Fire & Rescue Department to provide service to a small unincorporated area in
southwest Anaheim in which OCFA will pay Anaheim 65% of the secured Structural Fire
Fund revenue generated in the service area with the term of the agreement retroactive
from July 1, 2015 and expiring on June 30, 2020.
Due to a potential conflict of interest, Mayor Tait abstained on this item. ROLL CALL VOTE'

Services, Inc., in an amount not to exceed $50,000, for continued skills assessment
services through June 30, 2018.
13. Approve and authorize the Executive Director of the Convention, Sports & Entertainment
AGR- Department to execute, implement and administer an agreement, and any other related
10643 documents, with Anaheim Arena Management, LLC (AAM) providing AAM the exclusive
right to sell naming rights sponsorships at the Anaheim Regional Transportation
Intermodal Center for a one-year term with two six-month optional renewals.
AGR- 14. Approve and authorize the Fire Chief to execute a transfer agreement with the County of
5191.G Orange, acting through the Sheriff -Coroner Department in its capacity as the lead agency
for the Orange County Operational Area, for reimbursement of funds expended under the
FY 2016 State Homeland Security Grant Program and amend fiscal year 17/18 Police
Department budget, in the amount of $250,000, for ballistic personal protective equipment
for the Orange County Fire Agencies and fiscal year 17/18 Fire Department budget, in the
amount of $160,000, for funding of Anaheim Fire Captain position assigned to Orange
County Intelligence Assessment Center.

7240.1 9. Approve the First Amendment to Agreement with Superior Property Services, Inc.,
increasing the agreement amount by $1,685,000 and extending the agreement for a
minimum of six months but no more than one year for graffiti removal services.
DISCUSSION: Council Member Khngrequested kzamend the item Uzreflect the term ofthe
contract as one year and commented positively on the service provided by the company
MOTION: Council Member KhOAmoved toapprove the item, 8Samended, tnreflect the contract
term for one year, seconded by Council Member Murray.
DISCUSSION: Council Member Barnes referenced the report where it indicated the salaries and
benefits portion of the monthly costs under the contract have increased by 125% and the cost for
annual service was $2.5million. She asked for clarification ofthe latter and Barry Bartlett,
Purchasing Agent, noted the $2.5million included salaries and benefits amwell omequipment,
overhead, and a variety of other things with the 125% just costs of the salaries and benefits
portion ofthe $2.5million. Headded, based onthe new RFP and new specifications, the
proposals submitted came in with a different level of staffing and when all the numbers were
added up, the cost came in at over $200,000 per month for the level of service requested.
Council Member Barnes noted the agreement in the agenda packet was from 2012 and did not
reflect the new proposals. Planning and Building Director David Be>mneradded the agreement
provided was the original contract and the new schedule of fees was attached in the amendment,
which shows the labor component of costs associated with the contract and Mr. Bartlett offered to
provide the additional information related tothe amendment and fees.
Council Member FoeSee|complimented Superior Property Services, Inc., for the excellent service
they provide and understood they would establish a regular route rather than depending on
resident calls. Haasked for clarification and Community Preservation Manager Sandra Sogert
reported in the current contract, there were talks about daily routes of hotspots and Superior was
very proactive infighting graffiti.

the contract term for one year instead of six months, K8r. Be/mer reported staff can terminate the
contract with areasonable amount ofnotice. Staff considered several options and decided to
continue the o]Dtne[t. by amendment, to give the City the flexibility tO renegotiate with Superior,
evaluate reducing coata, and consider alternative aerviceo, including the possibility ofbringing the
service in-house.
Council Member Moreno suggested approving the itemaspresented by staff, allowing the City
flexibility to negotiate further. In response tohis question, Acting City Attorney Kristin Pelletier
reported Council was voting onthe First Amendment to the agreement.
In response to Mayor Tait's question as to whether there was an urgency to act on this now, Mr.
Belmer responded affirmatively, noting the current contract expires July 13, 2017. Mayor Tait
stated he was uncomfortable with doubling the term of the contract to one year and felt staff
needed flexibility Uodeal with budget issues.
Council Member P{riQ0withdrew her motion.

o116 19. Discuss information regarding recent conversations by the Mayor and members of the
City Council toconsider outsourcing 0fAnaheim Fire & Rescue 1VOrange County Fire
Authority, ensure public notification ofany discussions to outsource Anaheim Fire &
Rescue, and provide staff with direction onsuch matters.
DISCUSSION: Mayor Tait shared a conversation hehad with Orange County Fire Authority Chief
Bowman and stated if the City were to outsource Anaheim Fire & Rescue to the Orange County
Fire Authority, it would have to make sense from the City point of view, from a service point of
v|evv, and considering the interests of firefighters serving in the Anaheim Fire Department. He
reported an inquiry was made and the Firefighters Association expressed interest in conducting a
study. He reported discussions have been put on hold until fire negotiations are over and he was
open todiscussions ifthe Firefighters Association was open t0it.
Council Member Murray reported requesting this item, noting Kwas disappointing that the Fire
Chief, City Manager, City staff, and Council colleagues had tolearn about instruction given to
another agency to reach out proactively to one of the City's bargaining units and vote, at an
executive level, on whether they would consider moving forward with outsourcing fire services
and she added the interests ofdispatchers were not considered at all. She requested the Mayor
vvOrh within the confines of the City in any discussions that would involve contracting out city
services. She reported reaching out b]the Union President and the Board, noting they did not
vote toconsider the issue, but tabled the item because ofpending contract negotiations. She felt
it important to have the opportunity to address the issue publicly and to have other bargaining
units have eseat atthe table for future discussions. Council Member Murray stated the Anaheim
Fire Department is one of 46, Class 1, ISO -Certified Fire Departments in the nation, a status that
ievery difficult tnachieve. She added she will not support contracting out fire services.

Mayor Tait reported hedid not direct anyone tocontact the Firefighters Association but rather
asked Chief Bowman whether hethought they would beinterested inconsidering the possibility
of outsourcing. Headded nothing happened and advocated for astudy interms offinancial
viability toconsider the matter, reporting Santa Ana had done so. Mayor Tait stated Council
Members have aduty toask tough questions and beconcerned about the fiscal stability 0fthe
City.
Council Member Murray reported not all the Firefighters were hired bvthe C)CFAand they have
reduced services. She suggested iiwould have been better tocontact the Anaheim Fire
Department Chief and City Manager to set up a meeting with OCFA and have a discussion with
all stakeholders, in addition tVother bargaining units, including dispatch. She noted this was
about communication and professional courtesy.
Mayor Tait responded hewas not asking for a study and hehas many conversations, aaMayor,
that hedoes not share with anyone, relative @oinquiries about balancing the budget, pension
liabilities, and other matters,
In terms of a study, Council Member Murray stated Council should have a deliberation and ask
staff before asking officials from other agencies to intercede in City business.
Council Member Kring agreed direction should have been given to City staff and reported there
was alot odmiscommunication and confusion. She addressed the potential payment ofagate-
tax byottendeeStmC>isney|and.hote|submidieo.ondtranoientoccupanoytox(TOT)basedmn
increase room rates. She stated itwas unfortunate the Mayor did not talk tostaff and reported
firefighters were concerned with the news.
Council Member Moreno questioned why Council was spending so much time clarifying this
issue, as the Mayor has provided his intent, and addressed the politicization of various topics.
Council Member Murray stated her belief in transparency and h»|t this was the only way to relate
to the public that an idea was being considered, noting the actions taken had caused concerns of
residents and firefighters, and reported the City had a professional government, so staff can do its
due diligence onCouncil's behalf.
In response to Council Member Moreno's inquiry, Council Member Murray reported she received
many calls with inquires about the issue, she did not believe the Mayor's actions were
appropriate, and felt the matter had tohave apublic hearing for clarification.
Mayor Tait reported he never asked anyone to direct City staff to do anything, rather he called to
see if there was interest in moving the matter forward, further clarifying that he and Chief
Bowman agreed the matter should not be discussed further as the City was still in negotiations
with bargaining units.
Mayor Tait stressed he was doing his job, looking out for the people of Anaheim and trying to find
the best service, atreasonable prices, possibly saving the City alot ofmoney.
Council Member Faessel reported he generally approaches the City Manager or City staff with
any inquiries orideas.
Council Member Murray commented on the importance of including City staff in discussions and

Council Member Kringreported she usually goes tVthe City Manager first and alleged Jthe
Mayor would have contacted the City Manager first, there would have been no miscommunication

Council Member Moreno declared h8approaches the City Manager's office, the City is aChart8r
City where no directives are made to outside organizations, but felt it was appropriate to confer
with others oOideas. Heassured the public that any policy orbudget decision that will impact the
City would be considered by Council and hoped Council Members will respect each other's ability

Planning and Building Director David Be|mer presented the public hearing, noting the City was
currently operating under the 2013edition Cfthe Building Code and adoption Ofthis item will bring
the City under the 2010edition ofthe Building Code. This item was a second reading of the
ordinance and the required public hearing in order to adopt the 2016 edition of the Building Code.
He reported there were opportunities to provide interpretation, and where there was room for
inte[pretadon, staff attempted to be as flexible as possible to ensure public safety. He stated staff
has done a tremendous job in simplifying the code, making it less confusing for developers and
engineers.

wondered whether the City was cutting corners in terms of the Building Code, and hoped Council

DISCUSSION: Council Member F3es88|referenced Section 5.03.O5O.D30'which requires
continuous inspection of aluminum wire and asked how that will be done.
Mr. Belmer and staff reported the City conducts inspections and this requirement has been in the
ordinance for many years.
Council Member Faessel expressed concerns regarding "continuous" and enforcement, as there
was no definition of "continuous inspection" and it was not included in the California Electrical
Code orthe National Electrical Code.
Mayor Tait suggested approving the ordinance and scheduling a study session to discuss the
issue further.
