193110, ORDINANCE NO. 1931 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELAT- ING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 873 -- Series 1963-64 in Reclassification No. 62-63-126 , recommending an amendment to Title 18 of the Anaheim Municipa�- Code and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public hearing thereon in the manner and as prescribed in said Title 18 of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission did make find- ings and summaries of its hearing and did recommend a change or changes of zone or zones as set forth in said resolution; and WHEREAS, upon receipt of said resolution, report of findings, summary of evidence and recommendation of the City Planning Commission, the City Clerk did fix the 17th day of September , 1961_, as the time, and the Council Chamber in the City Hall of the City of Anaheim as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard -and did receive evidence and reports, and did there- upon consider the recommendation of the City Planning Commission, and did adopt Resolution (s) No. (s) 63R-759 , finding and determining that Title 18 of the Anaheim Municipal Code should be amended and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolu- tion(s); and WHEREAS, in accordance with said Resolution(s) 63R-759 , certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: - 1 - 62-63-126 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1. The South 89 feet of the North 254 feet of the West 180 feet of the North 5 acres of the West 20 acres of the North half of the Northwest quarter of Section 18, Township 4 South, Range 10 West, S.B.B.& M. PARCEL 2. The East 12 feet of the West 180 feet of the North 165 feet of the Northwest quarter of Section 18, Township 4 South, Range 10 West, S.B.B.& M. EXCEPTING THEREFROM the North 66 feet as conveyed to the State of California by deed recorded August 30, 1955 in Book 3192, page 168 of Official Records. PARCEL 3. The East 50 feet of the West 230 feet of the North 254 feet of the Northwest quarter of the Northwest quarter of the Northwest quarter of Section 18, Township 4 South, Range 10 West in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California. EXCEPTING the North 66 feet thereof, as conveyed to the State of California by deed recorded August 30, 1955 in Book 3192, page 168 of Official Records. now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in C-1, NEIGHBORHOOD -COMMERCIAL ZONE, upon the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 2. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked "Exhibit No. 1, Revision No. 3," and "Exhibit No. 2." 3. That tree wells shall be provided at approximately 40 -foot intervals in the Lincoln and Magnolia Avenues frontages abutting subject property; that plans for said tree wells and the landscaping therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted prior to final building inspection. -2- 0 4. That a six-foot strip of land shall, be landscaped and said landscaping maintained as indicated on - Exhibit No. 1, Revision No. 3, on file with the City of Anaheim; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 5. That all air conditioning facilities shall be contained within the building or properly shielded from view. 6. That a five-foot masonry wall shall be constructed along the easterly property line; and at the request of the abutting property Owner a six-foot masonry wall shall be constructed along the southerly property line, -said walls to be constructed prior to final building: inspection. SECTION 2. The City zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map tea be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. _ The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once with -in fifte-en (15) days after its adoption, in the Anaheim Eu1-1=eZin, a-:no-wspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
