2003-064RESOLUTION NO. 2003R- 64 A REsoLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING SUBMITTAL OF AN APPLICATION FOR A CODE ENFORCEMENT GRANT FROM THE STATE OF CALIFORNIA, INCURRING THE OBLIGATIONS 1N CONNECTION WITH SUCH GRANT AND AUTHORIZING THE DEPUTY CITY MANAGER TO EXECUTE ANY DOCUMENTS AND AMENDMENTS THERETO IN CONNECTION WITH SUCH GRANT WHEREAS, the City of Anaheim, a charter city within the State of California, wishes to apply for and receive an allocation of funds through the Code Enforcement Grant Program; and WHEREAS, the California Department of Housing and Community Development ("HCD") has issued a Notice of Funding Availability ("NOFA") for the Code Enforcement Grant Program established by SB 1227 (Burton) at Chapter 26 of the Statutes of 2002 and codified at Section 53533(a)(6) of the health and Safety Code. Pursuant to said statute, HCD is authorized to approve funding allocations for the Program, subject to the terms and conditions of the NOFA and program application forms. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The City of Anaheim shall submit to HCD an application to participate in the Code Enforcement Grant Program in response to the NOFA issued February 14, 2003 which will request a funding allocation in an amount not to exceed $300,000.00 for the purchase of the capital assets identified in the application to be used in the City of Anaheim. The application also commits the applicant to use, support and maintain the capital assets acquired with grant funds for at least three years. 2. If the application for funding is approved, the City of Anaheim hereby agrees to use the funds for eligible capital assets in the manner presented in the application as approved by HCD and in accordance with the NOFA and application package. It may also execute any and all instruments required by HCD for participation in the Code Enforcement Gr~nt Program. 3. The City of Anaheim authorizes the Deputy City Manager to execute in the name of the City of Anaheim the application, the Standard Agreement, and all other documents required by HCD for participation in the Code Enforcement Grant Program.
