1918ORDINANCE NO. 1918 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass -and adopt Resolution No. 508 -- Series 1962-63 in Reclassification No. 61-62-123, recommending an amendment to Title 18 of the Anaheim Municipal Code and a change or changes in the boundaries of the zone or zones herein- after mentioned and described, after having held a public hearing thereon in the manner and as prescribed in said Title 18 of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission did'make findings and summaries of its hearing and did recommend a change or changes of zone or zones as set forth in said resolution; and WHEREAS, upon receipt of said resolution, report of findings, summary of evidence and recommendation of the City Planning Commission, the City Clerk did fix the 30th day of October, 1962, as the time, and the Council Chamber in the City Hall of the City of Anaheim as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and didgive notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did there- upon consider the recommendation of the City Planning Commission, and did adopt Resolution No. 62R-971, finding and determining that said change of zone or zones should not be granted; and WHEREAS, thereafter, revised plans and a new application for reclassification of the property described in the above- mentioned proceedings having been filed with the City of Anahein under Reclassification 62-63-72, the City Planning Commission did adopt its Resolution No. 644 --Series 1962-63 recommending a change or changes in the boundaries of the zones as set forth in said resolution, after having held a public hearing thereon; and WHEREAS, upon receipt of said resolution the City Clerk did fix a time and place for a public hearing on said proposed change of zone or zones under Reclassification No. 62-63-72, and did hold said hearing and did defer action on said reclassi- fication to a later date to consider the same in conjunction with a rehearing on Reclassification No. 61-62-123; and 61-62-123 -1- WHEREAS, the rehearing on Reclassification No. 61-62-123 having been held on April 16, 1963 in conjunction with Reclassi- fication No. 62-63-72, the City Council did thereupon adopt its Resolution No. 63R-305 finding and determining that Title 18 of the Anaheim Municipal Code should be amended as recommended by the City Planning Commission under Reclassification Pro- ceedings No. 61-62-123 and as set forth in said resolution, and rescinding Resolution No. 62R-971; and . WHEREAS, in accordance with said Resolution 63R-305, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: The South 333 feet of the West 976 feet of the Southwest Quarter of the Southwest Quarter of Section 13, Town- ship 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California. EXCEPT the South 203 feet of the nest 203 feet. PARCEL 2: The South 500 feet of the West 590 feet of the South- west Quarter of the Southwest Quarter of aforementioned Section 13. EXCEPT the South 333 feet. PARCEL 3: The Southwest Quarter of the Southwest Quarter of Section 13, being a portion of Lot 41 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 2, pages 256 and 257 of Patents of Los Angeles County, w California. EXCEPT THEREFROM the North 20 acres. ALSO EXCEPT the South 500 feet of the West 590 feet. ALSO EXCEPT the South 333 feet of the West 976 feet. -2- now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in the following zones upon the conditions hereinafter set forth: 0 That Parcels 1 and 2 above described be changed to and incorporated in C-1, NEIGHBORHOOD-COMMERIAL ZONE: and That Parcel 3 above described be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE. That said change of zones shall be made upon the following conditions: 1. That the final tract map of subject property shall be recorded in the Office of the County Recorder of Orange County, California. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department for both the C-1 and R-3 developments, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 4. That a six-foot masonry wall shall be constructed along the north and east boundaries of subject property, unless said wall is specifically waived, in writing, by the abutting property owners; and that said wall, if not waived, shall be constructed prior to final building inspection. 5. That a six-foot masonry wall shall be constructed on subject property as follows: Commencing at a point on Ball Road 284 feet west of the east property line, thence north 259.8 feet; thence west 377 feet; thence north 145 feet; thence west 501.1 feet to the westerly property line on State College Boulevard. 6. That landscaping shall be installed and maintained along the north side of the most northerly block wall, as mentioned in Condition No. 5 hereof. 7. That a strip of land of a minimum width of six feet shall be landscaped and said landscaping maintained along the State College Boulevard and Ball Road rights-of-way abutting subject is property; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection of any structures erected on the C-1 property. -3- 8. That subject property shall be developed sub- stantially in accordance with plans on file with • the City of Anaheim marked "Exhibit No. V. 9. That plans for all commercial buildings shall be subject to review by the Architectural -Control Committee; provided, however, that the north and east elevations of the proposed commercial buildings shall be compatible with the projected multiple -family residential development. SECTION 2. • The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated,- and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the Cit yy Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
