1898• • ORD,I.N?�NCE NO. 1898 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM FMNICIPAL CODE RELAT- ING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 71-- 5r'esS_1gg,2-63 in Reclassification No. 62-63-83 , recomme di- g an amendment of Title 18 of the An eim Municipa Code and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public hearing thereon in the manner and as prescribed in said Title 18 of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, said. City Planning Commission did make find- ings aid summaries of its hearings and did recommend a change or changes of zone or zones as set forth in said resolution; and WHEREAS, upon receipt of said resolution, report of findixng3, summary of evidence and recommendation of the City Planning Commmission, the City Clerk did fix the 9th day of April , 19 63 , as the time, and tFe Counc�.l ie aniber in tpity Ha o?—the City of Anaheim as the place, for a public hearing upon said proposed amendment to 'Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 1.8 of the Anaheim Municipal Code; and 141HEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give. all parsons interested therein an opportunity to be heard and did receive evidence and reports, and did there- upon consider the recommendation of the City Planning Commission, and dial adopt Resolution 1�s) No. (s) 63R-283 , finding and determining that Title 18 of the Anaheim Municipa Code should be amended and that a change or changes in the boundaries of said zones or zones should be made as set forth in said resolu- tion(s); esolu- tion (s); and WHEREAS, in accordance with said Resolution(s) 63R-2&3 , certain conditions and requirements were IRE as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOWD THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS-. SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows-. 62-63-83 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of Lot 4 and of Lot 5 of Anaheim Extension, as shown on a Map of.Survey by William Hamel, a copy of which is shown in Book 3, pages 162 to 164 inclusive of "Los Angeles County Maps," in the office of the • County Recorder of Orange County, California, described as follows: Beginning at a point on the center line of Center Street, as shown on said map, distant North 740 37' 25" East 950.13 feet from the inter- section of said center line with the center line of East Street, as shown on said map; thence North 740 37' 25" East along said center line of Center. Street 168.27 feet to the Southerly prolongation of a line parallel with and distant Easterly 24.29 feet, (measured along the Southerly line) from the Westerly line of Lot 5 of said Anaheim Extension; thence North 15° 27' 55" West along said parallel line, 480.00 feet to the Easterly prolongation of the Southerly line of the land described in a deed to Zion Evangelical Lutheran Church of Anaheim recorded June 30, 1961 in Book 5770, page 813 of Official Records; thence South 74° 37 25" West along said prolongation and along said Southerly line, 168.78 feet to a line parallel with said center line of East Street and passes through the point of beginning; thence South 150 24' 15 East along said parallel line 480.00 feet to the point of beginning. now is C-1, NEIGHBORHOOD -COMMERCIAL and R -A, RESIDENTIAL - AGRICULTURAL ZONES, and that it be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 2. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 3. That fire hydrants shall be installed as required and determined necessary by the Chief of the Fire Department, prior to final building inspection. 4. That subject property shall be developed sub- stantially in accordance with Exhibits Nos. 1, 2 and 3, as amended herein, on file with the City of Anaheim. 5. That a six-foot masonry wall shall be constructed along the northerly boundary of subject property prior to final building inspection. -2- 6. That tree wells shall be installed at 40 -foot intervals along the parkway • portion of Lincoln Avenue abutting subject property, prior to final building inspection. SECTION 2. • The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
