18770 ORDINANCE NO. 1$77 AN ORDINANCE OF THE CITY OF ANAHEIM, CALIFORNIA, ORDERING, CALLING, PRO- VIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON OCTOBER 8, 1963, FOR THE PURPOSE OF SUBMITTING TO THE QUALI- FIED VOTERS OF SAID CITY SIX PROPOSI- TIONS TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR CERTAIN MUNICIPAL IMPROVEMENTS. WHEREAS, the City Council of the City of Anaheim, California, did on July 23, 1963, by a vote of at least two-thirds of the members thereof, adopt Resolution No. 63R-622 entitled "Resolution of the City Council of the City of Anaheim, California, determining that the public interest and necessity demand the acquisition and construction of certain municipal improvements, and making findings relating thereto." NOW, THEREFORE, the City Council of the City of Anaheim, DOES ORDAIN as follows: Section 1. That a special election be held and the same is hereby called to be held in said city on October 8, 1963, for the purpose of submitting to the qualified voters of said city the six propositions hereinafter set forth of incurring indebtedness and issuing bonds of said city therefor, in the amounts hereinafter set forth, and for the objects and purposes set forth in said resolution and in the ballot proposi- tions r ions hereinaf to set forth. Section 2. That the estimated cost of the • municipal improvement described in Proposition W, herein- after after set forth, is the sum of $4,900,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $4,900,000. That the estimated cost of the municipal improvement described in Proposi- tion E, hereinafter set forth, is the sum of .$75Q pC Y_'.G ' and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $75,G' DGQ._J00:'., . That the estimated cost of the municipal improvement described in Proposition C, hereinafter set forth, is the sum of $3,000,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $3,000,000. That the estimated cost of the municipal improvement - described in Proposition L, as hereinafter set forth, is the sum of $500,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $500,000. That the estimated cost of the municipal improvement described in Proposition D, as hereinafter set forth is the sum of $2,500,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $2,500,000. That the estimated cost of the municipal improvement described in Proposi- tion S, as hereinafter set forth, is the sum of $750,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $750,000. The estimated cost of each of said municipal improvements includes the following: (a) legal or other fees incidental • to or connected with the authorization, issuance and sale of the bonds, and (b) the costs of printing the bonds and 2. • other costs and expenses incidental to or connected with the issuance and sale of the bonds. Section 3. That the maximum rate of interest to be paid on said indebtednesses shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable annually the first year and semi- annually thereafter, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. Section 4. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elec- tions Code of the State of California. Section 5. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL. INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the word "NO." All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. • If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. 3. 4. PROPOSITION W - WATER WORKS BOND PROPOSITION: Shall the City : of Anaheim incur a bonded indebt- edness in the principal amount of : = $4,900,000 for the purpose of the YES : acquisition and construction by said City of a certain municipal improvement, to wit: water storage • reservoirs and access roadways, filtration plant, telemeter con- trol building and system, utili- ties yard and buildings, water wells, water transmission mains, water distribution lines, pump- ing stations, vaults and for the foregoing,appurtenances and ap- purtenant works including the acquisition and improvement of ; NO any real property, easements, rights: of way, pipe, pumps, valves, fit- tings, meters, machinery, apparatus and other property necessary therefor? A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of a proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of a proposition. Section 7. That if any proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit, two-thirds of the 0 - votes of the qualified electors voting on said proposi- tion, bonds of said city, in not exceeding the principal amount stated in such proposition, shall be issued and 6. PROPOSITION D - STORM DRAIN BOND PROPOSITION: Shall the City of Anaheim incur a bonded indebtedness in the principal YES amount of $2,500,000 for the : acquisition and construction : by said City of a certain ; municipal improvement, to wit. storm drains with appurtenances and appurtenant work including the acquisition of all real property, easements, rights of way, apparatus, equipment NO and other property necessary : therefor? : PROPOSITION S - SEWER BOND : PROPOSITION: Shall the City of : Anaheim incur a bonded indebted- : YES : ness in the principal amount of $750,000 for the purpose of the : acquisition and'construction by said city of a, -certain municipal improvement, to wit: collecting y: trunk and sub -trunk sewers in- cluding the acquisition and im- provement of all lands, easements,: NO rights of way, pipe, pumps, : equipment, apparatus and other : property necessary therefor? Section 8. That for the purpose of holding said special election there shall be, and there are hereby established sixty-six (66) consolidated voting precincts designated as hereinafter stated. Each such voting precinct shall consist of a consolidation of regular election precincts in the City of Anaheim (of the numbers hereinafter stated) established for the holding of state and county elections, as said regular election precincts exist on the date of the adoption of this ordinance; provided that "Voting Precinct 66," hereinafter described, shall comprise that portion of regular Orange County election precinct East Anaheim within proposed Riverview Annexation No. 2 to the City of Anaheim if said annexation is completed and effective prior to October 8, 1963, the date of said election. The polling places for the respective precincts shall be the places hereinafter named. The persons hereinafter named, being competent and qualified electors and residents of said city and of their respective voting precincts, with the exception of persons hereinafter named with respect to Voting Precinct 66 who are competent and qualified electors and residents within said Voting Precinct 66, are hereby appointed officers of election for their respective voting precincts and they shall hold said election and make return thereof in the manner pro- vided b3t' law. 7.
