1853• • ORDINANCE NO. 1853 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELAT- ING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT -. WHERE -AS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 601 -- Series 1962-63 in Reclassification No. 62- , reFommen ing an amendment of Title 18 of the �Anaheim Munici Code and a charxge or changes in the boundaries of the zone or zones hereinafter mentioned and described., after having held a public hearing thereon in the manner and as prescribed in said Title 18 of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission did make find- ings and summaries of its hearings and did recommend a change or changes of zone or zones as set forth in said resolution; and VHEREAS, upon receipt of said resolution, report of findings, summary of evidence and recommendation of the City Planning Commission, the City Clerk did fix the 19th day of Februar 9 19 63 8 as the time, and the Council xamber in the City Ha oTo the City of Anaheim as the place, for a public, hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 1.8 of the Anaheim Municipal Code; and � �EREAS, at the time and place fixed for said public hearing, the City Couacril did hold and conduct such public hear- ing and died give all persons interested therein an opportunity to be heard and did receive evidence and reports, and diad there- upon consider the recommiendation of the City Planning Commission, and did adopt Resolution Vis) No. Qs`j 63R-146 , finding and determining that Title 18 of the Amax eim M-unicipa Code should be amended and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolu- t ion ( s ) ; and WHEREAS, in accordance with said. Resolution(s) 63R-146 9 certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS-. SECTION to That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows-. 1 62-63-57 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lot No. 99 of Tract No. 1453 as shown on a map recorded in Book 42, pages 41 and 42 of Miscel- laneous Maps, Records of Grange County, California; • now is R -l. ONE -FAMILY RESIDENTIAL ZONE, and that it be changed to and incorporated in C-1, NEIGHBORHOOD-COIVM CIAL ZONE, upon the following conditions: 1. That subject property shall be developed substan- tially in accordance with plans marked "Exhibits Nos. 1 and 2,t1 except as amended herein, on file with the City of ,Anaheim. 2. That a strip of land of a minimum width of 6 feet, abutting the front property line, shall be land- scaped and said landscaping maintained; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Main- tenance; and that said landscaping shall be in- stalled prior to final building inspection. 3. That a minimum building setback of 50 feet shall be established and maintained from the westerly boundary of the alley on the west side of subject property for any 2 -story structures, and no win- dows shall be installed in the rear of the second story of any 2 -story buildings. 4. That any signs proposed to be installed on subject property, other than unlighted signs having a maximum area of 8 square feet, shall be submitted to the City Council for approval. 5. That off-street parking facilities shall be pro- vided as required by the .Anaheim Municipal Code, prior to final building inspection. 6. That no existing residential structure shall be used for commercial purposes unless remodeled to commercial standards. 7. That a sufficient building setback from the exist- ing alley shall be established to permit proper turning radius into the parking spaces; and that pipes or concrete posts shall be installed on the side of the alley opposite the subject property, as required by the Director of Public Works and. Superintendent of Streets, to protect the resi- dential properties from damages to fences by cars that might be turning into or backing out of sub- ject property. 8. That the damaged and/or hazardous sidewalks along Harbor Boulevard shall be repaired as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. • 9. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. - 2 - SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said. City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
