1834ORDINANCE NO. 1834 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. . is THAT-. THE CITY COUNCIL OF THE CITY :OF ANAHEIM DOES FIND WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No, 3L.9-- _,oriZR .�9� r6 in Reclassification) No. 61-62-107 , recom.6ending an amendment of Title 18 of the Anaheim Municipal Code,and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public nearing thereon in the manner and as prescribed in said Title I& of the Anaheim Municipal Code to consider such proposed change or changes of zone .or zones, and after i received evidence and reports from persons interested therein, and WHEREAS, said City Planning Commission did make findings and sumMaries of its hearings and did recommend a change or changes of zone or zones as set forth It Said resolution; and WHEREAS, upon receipt of said resolution, report of findiligs, summary of evidence and. recommendation: of the City Plag;iing Commission, the City Clerk did fix the 10th day of 19 62 , as the time, and the ouncil.Chamber n the City Hall of th-ety of Anaheim.as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code" and change or changes of zone or zones, and did° give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said pull is hearl0g,,, the City Council did hold and conduct such public: ,-arinq and di'd give all persons interested therein an opportunity to be ;hear.f and 'did :receive. evidence :and reports, and .d:id thereupon consider, the recommendation, of the City Planning Cotamission, and did adopt 'Resolution (s) No (s) 62Ra-637 finding. and .de3tef-mining that Title 18 of the Anaheim Municipal Code shauldi* b i#iended and that a change or changes in the boundaries of said zof7'e :or zones should be made as set forth in said resolution(s); and WEEREAS, ir, aiccordance with said' Resolution (s) 62R-637 , certain conditions and requirements were m�e as conditions precedent to the making of a change or changes of said zone or zones; and �4':,Z�'EA4S, all conditions precedent to said change or changes of zone or zones have been complied with; -I - 61-62-107 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows That all of the area situated in the City of Apaheim, County of Orange, State of California, described as followsp to wit: PARCEL 1.: That portion of Lot 21 in the J, D. Taylor Tract as shown on a map thereof recorded in book 36, pages 58 and 59, Miscellaneous Records of Los Angeles County, California, lying in the city of Anaheim, described as follows: Beginning at a point in the center line of Cross Street, (now known as Jefferson Street) said point being the intersection of the Westerly prolongation of the Northerly line of said Lot 21; thence along the Northerly line of said Lot 21 North 73° 311 00`= East, 292,42 feet; thence South 36° 231 00" East, 488.54 feet; thence South ?3° 231 00" West, 2.6,688 feet to the Northwest corner of Parcel 4 (description to follow); thence North 170 001 00`t West, lL}.4.26 feet; thence North 360 23t 00" West, 1.0.75 feet; thence South 73° 001 0011 West, 160,00 feet to the center line of said Jefferson Street, 40,00 feet wide; thence North 170 00t 00" West along the center line of said Jefferson Street, 185,00 feet to the point of beginning. EXCEPT THEREFROM that portion lying in Jefferson Street and uture wi ening, Also the northerly 20.00 feet, the Northeasterly 20,00 and the Southerly 10,00 feet for alley purposes. A 20,001 cutoff for Northeast & Southeast corners. EXCEPT THEREFROM That portion lying in Jefferson Street and future widening. -2- PARCEL 3: Beginning at a point in the center line of said Jefferson Street South 170 00t 00" East. 336.08 feet from the center line intersection of Jefferson Street and the Westerly prolongation of the Northerly line of said Lot 21; thence North 73" 001 00" East, 93.00 feet; thence South 720 061 0011 East, 140.07 feet; thence South 170 001 0011 East, 45.61 feet; thence South 170 541 00" West, 126,97 feet to a point in the center line of Santa Ana Canyon Road (60.00 feet wide); thence North 72° 06t 00" West, 164.83 feet to the center line intersection of Jefferson Street and Santa Ana Canyon Road; thence North 170 001 0011 West along the center line of Jefferson Street, 135.75 feet to the point of beginning. EXCEPT THEREFROM that portion lying in Santa Ana anyon Road and Jefferson Street and also a 10.001 strip of land along the Southeasterly line of said Parcel 3 for alley purposes. PARCEL : Beginning at a point in the center line of Santa An Canyon Road (30.00 feet wide) South 72° 061 00" East, 164.83 feet from the center line intersection of Jefferson Street and said Santa Ana Canyon Road; thence North 17° 541 00`t East, 126.97 feet; thence North 730 231 00" East, 246.68 feet; thence South 360 231 00" East, 174.94 feet to a point in the Northwesterly line of a frontage access to Santa Ana Canyon freeway; thence South 44* 221 17" West along said frontage road, 44.06 feet to the beginning of a curve concave to the Northwest and having a radius of 172.00 feet; thence South and West along said curve and said frontage road through a central angle of 63° 31t 43" an arc distance of 190.71 feet to the end of said curve and a point in the Northeasterly line of said Santa Ana Canyon Road; thence South 17° 541 00" West, 30.00 feet to the center line of said Santa Ana Canyon Road; thence North 72® 06t 00" West, 171.63 feet along the center line of Santa Ana Canyon Road to the point of beginning. EXCEPT THEREFROM that portion lying in Santa Ana Canyon Road and also a 10.00 foot strip of land along the Northerly line of said Parcel 4. and also a 10.00 foot strip of land along the Northwesterly line of said Parcel 4 for alley purposes, now is R -A, RESIDENTIAL -AGRICULTURAL ZONE and that it be changed to and incorporated in the following zones, upon the conditions hereinafter set forth: That Parcels 1 and 4 above described shall be changed to R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE; and That Parcels 2 and 3 above described shall be changed to C-1, NEIGHBORHOOD -COMMERCIAL ZONE, upon the following conditions: -3- 1. That the owner of subject property shall pay to the City of Anaheim the sum of $25 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued, 2. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 3. That the Jefferson Street alignment shall conform to the Master Plan for Jefferson Street as approved by the County of Orange and the City of Anaheim. 4. That subject property shall be developed substantially in accordance with plans marked "Exhibits 1, 2, and 3" on file with the City of Anaheim. 5. That a landscaped strip of a minimum width of six feet shall be provided and said landscaping maintained along the proposed commercial development frontage of Jefferson Street; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 6. That a six-foot masonry wall shall be constructed along the north and east boundaries of subject property between the proposed R-3, Multiple -Family Residential development and the proposed C-1, Neighborhood - Commercial development; PROVIDED, HOWEVER, that should the Metropolitan Water District not permit the construction of said masonry wall abutting the Metropolitan Water District right of way, a six-foot wood fence or wall satisfactory to the Metropolitan Water District shall be constructed. 7. That buildings on the commercial portion of subject property, Parcels 2 and 3, shall be limited to commercial purposes only, and that buildings on Parcels 1 and 4 shall be limited to residential purposes only. That the existing structures on Parcels 1, 2, 3 and 4 shall be removed prior to the reading of the ordinance reclassifying subject property. C� SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within` fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
