1822ORDINANCE NO o 1822 AN ORDINANCE OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO THE CITY OF ANAHEIM OF THE TERRITORY KNOWN AND DESIGNATED AS CITY OF ANAHEIM OLIVE HILLS RESERVOIR ANN THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION to That the City Council of the City of Anaheim did on the 29th day of January , 19 63 , receive a written petition asking tM certain new territory described in said pe- tition be annexed to the City of Anaheim. That before the filing of said petition, the proposal for the annexation of the territory hereinafter described to the City of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries, the non-conformance of proposed boundaries with lines of assessment or ownership, the creation of islands or corridors of unincorporated territory and other similar matters affecting the proposed boundaries. That said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim, and is uninhabited terri- tory. That said petition contained a description of said territory in words and figures as hereinafter in this Ordinance described. That the City Council duly assembled at a --- regular meeting of said City Council held on the 29th day o January , 1963 , did find that said petition at the time it was filed—and receives was signed by the owners of not less than one-fourth of the land in the territory by area and by assessed value, as shown on the last preceding equalized assessment roll of the County of Orange, State of California, in which said territory is situated, and that said territory did not form a part of any municipal corporation, and did find that said territory is con- tiguous to the City of Anaheim and is uninhabited territory. That on the 29th day of January 31 1963 , at a -- remeeting o sai City Council of the City of An eim, Resolution No. 63R-$1 was duly passed and adopted specifically describing theo� undaries of the territory so proposed to be annexed to the City of Anaheim and designating such territory as CITY OF ANAHEIM OLIVE HILLS RESERVOIR ANNEXATION and giving notice oF sucFi annexation and fixing the 5th day of March , 1963 , at the hour of 3;00 0 clock P.M. at the City Council Chamber in the City Ha in t e City of Anaheim, as the day, hour and place for hearing of written pro- tests to said annexation and when and where any person owning real property within such territory so proposed to be annexed and having objections to the proposed annexation might appear before the City Council of the City of Anaheim and present written objections to the annexation of said territory to the City of Anaheim, and directing the City Clerk to publish or cause to be published a copy of said resolution at least twice, but not oftener than once a week, for two successive weeks prior to the date of said hearing, in a news- paper of general circulation, printed, published and circulated • in the City of Anaheim, to wit. The Anaheim Bulletin of Anaheim, Orange County, Cali ornia, =x x�x cxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx and directing that said publication be completed at east twenty (20) days prior to the date of hearing hereinabove mentioned; and further directing the City Clerk of the City of Anaheim to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the proceedings were initiated, at the address shown on said assess- ment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk; and that in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, that the City Clerk shall cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such C,)unty, and directing that such notices be given not less than twenty (20) days before the first public hearing on the proposed annexation. That on the hour, day and at the plane specified in said Resolution No. 63R-31 , to wit<. On the 5th day of March T$�'63 , at the hour o o'clock P.M. in the City Counci Chamb-e iin the City Hall f- ty of Anaheim, California, the City Council of the City of Anaheim did meet and assemble to hear and pass on all protests filed or received up to the closing of the hearing on said protests and the City Council did find that the resolution fixing the time and place of said hearing was published by the City Clerk as therein directed, and that written notice of such proposed annexation was mailed to each person to whom land within the territory proposed to be annexed is assessed, or in which such person has any interest, by the City Clerk as directed in said. resolution. That written protests were not made by the owner or owners of one-half of the value of the territory proposed to be annexed according to the last equalized assessment roll of the County of Orange, State of California, nor were protests made by public or private owners equal to one-half of the value of the territory proposed to be annexed as determined by the City Council. SECTION 2. That the annexation of the territory boundaries of the CITY OF ANAHEIM OLIVE HILLS ANNEXATION, and more particu ar y described as - 2 - included within th e RESERVOIR 0 ows, to wit. CITY OF ANAHEIM OLIVE HILLS RESERVOIR ANNEXATION A parcel of land located in theicxX>fci County of Orange, State of Cali- fornia, described as follows: Commencing at a point in the common boundary line between the City of Anaheim and the City of Orange as established by Anaheim Northeast Annexation No. 2-A, passed by Ordinance No. 1269 on August 12, 1958, and filed with the Secretary of State on September 12, 1958, and recorded September 17, 1958 in Official Records of the County Recorder, County of Orange, State of California, and Orange Annexation No. 92, passed by Ordinance No. 711 on October 8, 1957 and filed with the Secretary of State November 12, 1957, and recorded November 12, 1957 in Official Records of the County Recorder, County of Orange, State of California, said common boundary line herein- after described in part and established as follows: 'Commencing at the intersection of the heretofore mentioned common boundary line with the Easterly line of that portion of land conveyed to the State of California, described as Parcel 1 of deed recorded December 23, 1960 in Book 5563, page 227 of Official Records in the office of the County Recorder, County of Orange, State of California, said point of intersection being North 330 01' 38" East 87.41 feet from the Southerly terminus of that certain course described in the last mentioned deed as having a bearing of North 330 01' 38" East and having a distance of 503.61 feet, said point of intersection being hereinafter referred to as Point "A"; thence South 520 43' 23" East 578.82 feet; thence South 810 58' 54" East 1,335.06 feet; thence North 890 24' 10" East 2,640 feet, more or less, to Point "B", said Point "B" being the point of intersection with the East line of Section 9, Township 4 South, Range 9 West, S.B.B. & M., as referred to in the heretofore mentioned City of Anaheim Northeast Annexation No. 2-A, and the City of Orange Annexation No. 92, said point of intersection being South 00 36' 45" East 1,889.00 feet from an angle point in the Southwesterly line of Lot 11 of Tract No. 58, Peralta Hills Tract No. 1, recorded in Book 10, page 6 of Miscellaneous Maps, records of Orange County, California, said angle point being the Easterly terminus of a portion of the Southwesterly line of said Lot 11, which — 3 — City of Anaheim Olive Hills Reservoir Annexation bears North 890 43' West and has a length of 374.32 feet." The above described boundary line is hereinafter referred to as the "Common Boundary Line of 1957-58." Commencing at the heretofore mentioned Point ''A'; thence South 520 43' 23" East along the heretofore mentioned Common. Boundary line of 1957-58, a distance of 578.82 feet to an angle point therein; thence continuing along said Common Boundary Line of 1957-58, South 810 58' 54" East 1,060.67 feet to the point of intersection with a curve concave Northeasterly having a radius of 372.00 feet, a radial line passing through said point bearing South 790 15' 42" West, said point of intersection being the True Point of Beginning; thence 1. Leaving the heretofore mentioned Common Boundary Line of 1957-58 and following Southeasterly and Easterly along said curve through a central angle of 840 07' 07" an arc distance of 546.15 feet; thence 2. North 850 08' 35" East tangent to said curve 54.73 feet; thence 3. South 40 51' 25" East 42.00 feet, to the Northwest corner of that parcel of land con- veyed to the City of Anaheim described in Parcel No. Eight of deed recorded in Book 6355, pages 675 to 678, inclusive, Official Records of said Orange County; thence following along the Westerly line of Parcel No. Eight, the following courses and distances: South 120 21' 25" East 181.81 feet; thence South 280 11' 03" West 126.68 feet to the intersection with the Northerly line of that portion of land conveyed to the State of California, described as Parcel 2, recorded in Book 5563, page 227, Official Records of the County Recorder, County of Orange, State of California; thence 4. Continuing along the Westerly, Southerly and Easterly line of the heretofore, mentioned Parcel No. Eight conveyed to the City of Anaheim, the following courses and distances: South 890 19' 54" East 95.65 feet; thence South 680 51' 43" East 164.52 feet; thence South 380 06' 18" East 586.20 feet; thence South 640 22' 56" East 250.00 feet; thence South 740 35' 14" East 392.94 feet; thence North 720 24' 23" East 140.69 feet; thence North 450 11' 23" East 181.13 feet; thence North 140 57' 30" East 208.22 feet; thence North 210 51' 37" West 292.31 feet; thence North 350 25' 27" West 218.44 feet; thence 5. Leaving the Easterly line of said Parcel No. Eight and following along the Southeasterly line of Parcel No. Six, as conveyed to the City of Anaheim in the heretofore mentioned deed to the City of Anaheim, the following courses and distances: North 740 43' 06" East 14.50 feet to the beginning of a tangent curve concave - 4 - - City of Anaheim Olive Hills Reservoir Annexation Northwesterly having a radius of 115.00 feet; thence Northeasterly along said curve through a central angle of 160 41' 57", an arc distance of 33.52 feet; thence North 580 01' 09" East, tangent to said curve 355.09 feet to the intersection with the South line of Parcel No. Four as conveyed to the City of Anaheim in the heretofore mentioned deed; thence 6. Following along the Southerly and Easterly line of said Parcel No. Four, the following courses and distances: South 860 30' 00" East 35.51 feet to an intersection with a curve concave Westerly having a radius of 141.00 feet, a radial line passing through said point, bearing South 860 30' 00" East; thence Northerly along said curve, through a central angle of 230 27' 38", an arc distance of 57.73 feet to the intersection with the Southeasterly line of Parcel No. Seven as conveyed to the City of Anaheim in the heretofore mentioned deed; thence 7. Following along said Southeasterly line and its Northeasterly prolongation thereof; North 580 01' 09" East 503.83 feet to a point in the heretofore mentioned Common Boundary Line of 1957-58, said point being South 890 24' 10" West 381 feet, more or less, from Point "B" of the heretofore mentioned Common Boundary Line of 1957-58; thence 8. Along said Common Boundary Line of 1957-58, the following courses and distances: South 890 24' 10" West 2,259 feet, more or less, to an angle point therein; thence North 810 58' 54" West 274.39 feet to the True Point of Beginning. - 5 - �J is hereby approved and said territory is hereby annexed to and in- corporated in the City of Anaheim, County of Orange, State of California, and is hereby designated as the CITY OF ANAHEIM OLIVE HILLS RESERVOIR ANNEXATION to the City of Ana eim. SECTION 3� That from and after the effective date of this Ordinance and the filing of a certified copy thereof with the Secretary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of Anaheim, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of Anaheim and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Anaheim con- tracted prior to or existing at the time of such annexation pursuant to the written consent of the owners of property in said annexed territory filed with the Clerk of the City of Anaheim prior to the adoption of this Ordinance. SECTION 4. The City Clerk shall certify to the passage of this Ordi- nance and cause the same to be published once in the Anaheim Bulletin , a newspaper of general circulation, printe , pu - is ed an circulated in the City of Anaheim, County of Orange, State of California, and thirty (30) days from and after its final passage it shall be in full force and effect.
