RES-2018-060RESOLUTION NO. 2018 — 060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADDING POLICY 1.11 TO THE CITY COUNCIL POLICY MANUAL RELATING TO MANDATORY ETHICS TRAINING FOR CERTAIN CITY OFFICIALS AND CITY COUNCIL APPOINTED BOARDS AND COMMISSIONS WHEREAS, in California, state laws create a set of requirements that guide elected/appointed officials and agency staff in their service to their communities; and WHEREAS, promoting understanding of and compliance with the laws governing public service ethics is necessary; and WHEREAS, Assembly Bill 1234 was passed by the State Assembly and State Senate in August of 2005, signed by the Governor in October 2005 and codified, in part, in Government Code Section 53234, et seq.; and WHEREAS, Government Code Section 53234(c)(1) identifies certain positions that are required to attend mandatory ethics training and defines a Local Agency Official required to attend such training as any member of a local agency " legislative body" or any elected official who receives any type of compensation, salary, or stipend or reimbursement for actual and necessary expenses incurred in the performance of official duties; and WHEREAS, Government Code Section 54952(a) defines "legislative body" as the governing body of a local agency or any other local body created by state or federal statute, and subsection (b) further defines " legislative body" as a commission, committee, board, or other body of a local agency, whether permanent or temporary, decision making or advisory, created by charter, ordinance, resolution or formal action of a legislative body; and WHEREAS, Government Code Section 53234(c)(2) requires any employee designated by a local agency legislative body to additionally receive ethics training as specified by that agency. NOW, THEREFORE, BE IT RESOLVED: Section 1. Policy No. 1.11 entitled "Mandatory Ethics Training for Certain City Officials and City Council Appointed Boards and Commissions" is hereby added to the City Council Policy Manual as follows: "The City Attorney's office shall provide training in ethics similar in content to that required by state law, together with training on the Brown Act, to all appointed City Council boards and commissions at the first meeting or the meeting immediately thereafter following the scheduled annual appointments set forth in section 1.04.391.030 of the the Anaheim Municipal Code. This policy shall not substitute for the requirements of Government Code §53235, et. seq., and board and commission members required to participate in mandatory training pursuant to that section will participate in the required training. All staff of the city council who receive compensation shall complete ethics training as provided under §53235 of the Government Code, and such certificate of completion shall be posted on the city's Transparency in Government webpage." Section 2. This Resolution shall be effective immediately upon adoption.
