2003-065RESOLUTION NO. 2003R-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY Of ANAHEIM VACATING CERTAIN SLOPE, STORM DRAIN AND ELECTRICAL UTILITY EASEMENTS LOCATED AT THE NORTHWEST INTERSECTION OF SOLOMON DRIVE AND SANTA ANA CANYON ROAD(ABA Nos. 2002-00060, 61 and 62) WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law while reserving unto the City of Anaheim easements to maintain City property within said abandoned right of way; and WHEREAS, notice of a public hearing to consider said vacation was posted and published as prescribed by law; and WHEREAS, on the 1st day of April, 2003, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and WHEREAS, the abandonment approved herein does not convey right, title and interest to the abandoned property, which is conveyed by separate quitclaim deed pursuant hereto. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of certain slope, storm drain and electrical utility easements located at the northwest intersection of Solomon Drive and Santa Ana Canyon Road (Proposed Tract Map No. 16254), as more specifically described as follows: See Exhibit A attached hereto. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the County Recorder upon the completion of all conditions set forth herein, if any. Maag to the City of Anaheim, a municipal corporation, as shown on a Grant Deed recorded December 19, 1972, in Book 10477, Page 720, Official Records, in the Office of the County Recorder of Orange County, California, that lies within the boundaries of Tract No. 16254, as shown on a map recorded February 19, 2003 in Book 840, Pages 23 through 31 inclusive, of Miscellaneous Maps, in the Office of the County Recorder of said County. Maag to the City of Anaheim, a municipal corporation, as shown on an Easement Deed recorded February 4, 1974, in Book 1059, Page 1053, Official Records, in the Office of the County Recorder of Orange County, California, that lies within the boundaries of Tract No. 16254, as shown on a map recorded February 19, 2003 in Book 840, Pages 23 through 31 inclusive, of Miscellaneous Maps, in the Office of the County Recorder of said County. PARCEL THREE: That portion of that certain easement for storm drain purposes granted by Hazel I. Maag to the City of Anaheim, a municipal corporation, as shown on an Easement Deed recorded December 19, 1972, in Book 10477, Page 718, Official Records, in the Office of the County Recorder of Orange County, California, that lies within the boundaries of Tract No. 16254, as shown on a map recorded February 19, 2003 in Book 840, Pages 23 through 31 inclusive, of Miscellaneous Maps, in the Office of the County Recorder of said County.
