RES-2018-077RESOLUTION NO. 2018 - 0 7 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING LIFE SAFETY DIVISION FEES TO BE CHARGED BY THE FIRE AND RESCUE DEPARTMENT OF THE CITY OF ANAHEIM AND RESCINDING RESOLUTION NO. 2013-122. WHEREAS, the City Council has heretofore adopted a fee schedule for services rendered by the Anaheim Fire and Rescue Department; and WHEREAS, the City Council desires to approve a revised fee schedule and establish the effective date of said fees; and WHEREAS, the fees so established and the categories so modified have been considered at a duly noticed public hearing as required by law; and WHEREAS, the City Council hereby finds that said fees, in the amounts hereinafter set forth in Exhibit A are less than or equal to, but in no event greater than, the actual direct and indirect costs and expenses incurred by the City in performing the services connected with such fees; and WHEREAS, the City Council hereby finds and declares that adoption of this fee schedule is exempt from the provisions of the California Environmental Quality Act pursuant to Section 21080(b)(8) of the Public Resource Code; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the fees set forth below be, and the same are, hereby established as follows: Section 1. The fees set forth in the fee schedule attached hereto as "Exhibit A" shall be, and the same is, hereby adopted. Section 2. The fees established herein shall become effective ninety (90) days following the date of adoption of this Resolution. Section 3. The fees established herein shall, upon the effective date of said fees, supersede fees set forth in Resolution No. 2013-122 and any previously adopted fees for the same permit or approval. Section 4. The City Council hereby declares that should any one or more fees established by the Resolution or any portion of this Resolution be declared for any reason to be invalid, it is the intent of the City Council that it would have adopted all other fees and portions of this Resolution independent of the elimination here from any such fee or such portion as may be declared invalid. BE IT FURTHER RESOLVED that Resolution No. 2013-122 is hereby rescinded upon the effective date of the new fee schedule. EIRs, CUP's and other related cases, review state -regulated facilities. $33 per % hour Stand-by Fee This fee is applicable only for those instances when the Fire Marshal, Fire Chief, or designee determines that stand-by personnel are needed to mitigate an exigent circumstance. 1. Required stand-by personnel during normal business hours are performed at an hourly rate. Required stand-by personnel after 5:00 PM and on weekends (minimum 2 hours on weekends). 30 Day Penalty Failure to submit fees within forty-five (30) days of original billing. 60 Day Penalty Failure to submit fees within sixty (60) days of billing.
