RES-2018-091RESOLUTION NO. 2018- 0 91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A REVISED SCHEDULE OF PERMIT PARKING FEES AND RESCINDING RESOLUTION NO. 2016- 011 AND DETERMINING SUCH ACTIONS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 15060(C)(2), 15060(C)(3) AND 15061(B)(3) OF THE STATE OF CALIFORNIA GUIDELINES FOR IMPLEMENTATION OF CEQA (ANAHEIM MUNICIPAL CODE SECTION 14.32.450) WHEREAS, it is the policy of the City Council of the City of Anaheim (the "City") to provide for the amount of fees to be established by resolution; and WHEREAS, the City Council has established a revised procedure for creation of permit parking districts as set forth in Anaheim Municipal Code Section 14.32.450; and WHEREAS, the City Council has previously adopted Resolution No. 2016-011 adopting a revised schedule of certain permit parking fees; and WHEREAS, the City Council desires to establish a revised schedule permit parking fees; and WHEREAS, City staff has estimated the cost of time and materials necessary to process various types of parking permits; and WHEREAS, the City Council has by resolution and ordinance established fees for parking permits which reflect the costs necessary to process said permits; and WHEREAS, it is the desire of the City Council to revise and update said fees at this time to include a fee that reflects the costs necessary to process said permits; and WHEREAS, the fees hereinafter amended do not exceed the estimated reasonable cost of providing the service for which the fees are charged; and WHEREAS, the City of Anaheim has heretofore complied with the applicable requirements of Chapter 8 of Division 1 of Title 7 of the Government Code of the State of California entitled Procedures for Adopting Various Fees; and WHEREAS, the City Council finds and determines that this amendment to fees is exempt from the provisions of the California Environmental Quality Act pursuant to Section 15060(c)(2), 15060(c)(3) and 15061(B)(3) of the State of California Guidelines for Implementation of CEQA. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the fees to be charged and collected shall be as set forth in Exhibit A, which is attached hereto and incorporated by reference herein. BE IT FURTHER RESOLVED that the fees established herein shall, upon the effective date of such fees, and shall supersede any previously adopted fees for obtaining parking permits. BE IT FURTHER RESOLVED that Resolution No. 2016-011 is hereby rescinded in its entirety.
