2003/04/15 ANAHEIM, CALIFORNIA - CITY COUNCIL MEETING ADJOURNED REGULAR MEETING APRIL 15, 2003 The City Council of the City of Anaheim met in adjourned regular session. The Notice of Adjournment was posted at 3:00 P. M. on April 15, 2003 on the exterior door of the Anaheim Council Chambers, announcing the adjournment to April 15, 2003 at 4:00 P.M. for the purpose of Closed Session. PRESENT: Mayor Curt Pringle, Council Members: Tom Tait, Shirley McCracken, Bob Hernandez and Richard Chavez. STAFF PRESENT: City Manager David Morgan, City Attorney Jack White, City Clerk Sheryll Schroeder. A copy of the agenda for the meeting of the Anaheim City Council was posted on April 11, 2003 at the City Hall outside bulletin board. Mayor Curt Pringle called the regular meeting to order at 4:10 P.M. in the Council Chambers of the Anaheim City Hall, 200 South Anaheim Boulevard. ADDITIONS/DELETIONS TO CLOSED SESSION: None. PUBLIC COMMENTS - CLOSED SESSION ITEMS: None. Mayor Pringle recessed to Closed Session at 4:11 P.M. 1. INVOCATION: Pastor Ed Bartel, Sunkist Community Church FLAG SALUTE: Mayor Pro Tern Tait Council Member Tait noted that the city lost a member of the Anaheim family, Sgt. Edward Smith, who gave his life in Iraq for our freedom and for the freedom of the people of Iraq. He requested a moment of silence in honor of Marine Sgt. Smith. PRESENTATIONS: Proclaiming April 21 - 25,2003, as Tree Appreciation Week. PROCLAMATIONS AND DECLARATIONS: Recognitions to be presented at a later date were: Proclaiming April 27 - May 3,2003, as Record-A-Thon Week. Recognizing Kathy Wilburn on her retirement from Patrick Henry School. Proclaiming April 27 - May 4, 2003, as Days of Remembrance. Proclaiming April 13 - 20, 2003, as Restorative Justice Week. At 5:23 P.M., Mayor Pringle recessed the City Council meeting until after the Redevelopment Agency and Anaheim Housing Authority meetings. At 5:24 P.M., Mayor Pringle reconvened the Anaheim City Council for purposes of a joint public hearing with the Redevelopment Agency. 5:00 p.m. Continued Joint Public Hearina: 123 5. Consider a Disposition and Development Agreement between the Redevelopment Agency and Zelman Retail Partners, Inc. for the West Anaheim Commercial Corridors Redevelopment Project (Continued from the Council meeting of March 25, 2003, Item 4). Item 5 was requested to be withdrawn by staff. Mayor Pringle noted the item would return at a later date. Mayor Pringle recessed the City Council. Mayor Pringle reconvened the City Council meeting at 5:29 P.M. ANAHEIM CITY COUNCIL MEETING MINTUES APRIL 15, 2003 PAGE 3 AdditionslDeletions to the Agenda: City Clerk Sheryll Schroeder announced that staff had requested that Item A14 be removed from the agenda. Public Comments: James Reade pleaded the case of unfair imprisonment of an Anaheim Hills legal immigrant who emigrated with his family from Iran. Debbie Schroeder, Principal of Edison Elementary School, introduced and acknowledged members of her staff and residents that were attending the meeting. She noted that there was a working collaboration between her school, members of the community and the Police Department, which had resulted in an improved formation of community programs. Michael Baker, Executive Director of the Boy's and Girl's Clubs of Anaheim, reminded Council of a fund raiser on May 17, 2003 at the Anaheim Convention Center. Proceeds of the event will benefit the Motel Children Program. Peter Healey addressed Council as both a representative of the Anaheim Municipal Employee Association and also as a resident. He urged Council to consider a letter that was sent to City Manager Morgan, regarding cutting in half the staff of the Anaheim Fire Department Life Safety Unit. City Manager Morgan responded that part of the budget preparation process has had to deal with the economic realities of the effects of the economy, adding that this has meant that staff has had to look at appropriations and at some reallocations and prioritizations. The proposals have not been published at this time, he added, Council would be given the budget proposal on May 1, 2003. City Manager Morgan noted at that time Council will have their opportunity to deliberate on the issue. Mr. Morgan stated that the proposed budget does not create additional risk, but that will be for Council to determine. Mayor Pringle told Mr. Healy that he had read his letter and that he was not aware of the precise issue because the City Manager had not presented the new budget to the Council as yet. Part of Council's obligation was to figure out how to survive during tough economic times and to make sure that they address all the issues within the budget. He knew that the City Manager was looking at every area possible. The area of public safety, he explained, was the most significant area for the city to maintain and he assured everyone that Council would do that to ensure that the public would not be at risk. He noted he understood his concern for the two positions, but he also wanted to reassure people that they needed to look at every area. He stated it was Council's responsibility to make sure that staff had all the resources available to make sure that the residents of the community were safe, first and foremost. As the Council worked through the rather difficult process, he did not think this was in any way a final step along the path and when, in fact the budget is presented to Council in May, Council will review it, discuss it, and everyone will have a full opportunity to share specific concerns along the way. Council Member Chavez added that it was a little more difficult for the Fire Department and the AMEA members that have received notices that they were going to be laid off. Mr. Healy said that one of his members had already received notice that he was going to be laid off. Council Member McCracken noted that the motion included the waiver of reading in full of all ordinances and resolutions. Roll call vote: Ayes - 5; Mayor Pringle, Council Members Tait, McCracken, Hernandez, Chavez. Noes- o. Motion carried. A 1. Reject certain claims filed against the City. A2. Receive and file the Monthly Financial Analysis Report presented by the Finance Director for eight months ended February 28, 2003; minutes of the Golf Advisory Commission meeting held February 27,2003; minutes of the Redevelopment and Housing Commission meeting held March 5, 2003; minutes of the Public Library Board meeting held March 10,2003. A3. Accept the bid of West-Mark, Inc., in the amount of $76,390 (plus tax), for one custom 1,500 gallon rubber line steel tank truck conversion for Fleet Services in accordance with Bid #6358. A4. Accept the bid of BoundTree Medical, in an amount not to exceed $150,000, per year, with four one-year options to renew, for medical supplies required by the Fire Department and authorize the Purchasing Agent to exercise the renewal options in accordance with Bid #6362. A5. Adopt a Negative Declaration of Environmental Impact for the widening of Ball Road in front of three properties situated along Ball Road between 900 feet west of Knott Avenue and 800 feet west of Western Avenue. A6. Approve an Agreement for Acquisition of Real Property with Roger J. Work and Denise A. Work, in the payment amount of $35,000, for real property located at 3601 Ball Road. A7. RESOLUTION NO. 2003R-66 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM accepting certain deeds conveying properties or interests therein (City Deed Nos. 10601, 10602, 10603, 10605 and 10606). A8. RESOLUTION NO. 2003R-67 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM accepting certain deeds conveying to the City of Anaheim certain real properties or interests therein (City Deed Nos. 10607 and 10608). A9. RESOLUTION NO. 2003R-68 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM accepting certain deeds conveying to the City of Anaheim certain real properties or interests therein (City Deed Nos. 10609, 10610, 10611, 10612, 10613 and 10614 ). A 10. Approve the increase to revenues and expenditures in the City Administration Department's fiscal year 2002/2003 budget by $166,033. A 11. Approve and authorize the City Manager to execute the Amended and Restated Cooperation Agreement with the Redevelopment Agency for use of the United States Department of Housing and Urban Development Section 108 Loan funds (related to Agency Item 1). A13. Approve an addendum to a two-year agreement with Equifax Credit Information Services to extend the agreement through May 1, 2005 for credit services, in an amount not to exceed $44,400, and for services provided through the California Utility Exchange, in an amount not to exceed $23,280. 123 Removed from the agenda: A 14. Amend the Police Department's budget by increasing revenues and expenditures in the amount of $506,768 for fiscal year 2002/03. A 15. ORDINANCE NO. 5854 (INTRODUCTION) AN ORDINANCE OF THE CITY OF ANAHEIM amending the zoning map referred to in Title 18 of the Anaheim Municipal Code relating to zoning (Reclassification No. 2002-00077, 950 North Gilbert Street and 2360 West La Palma Avenue). A16. ORDINANCE NO. 5855 (INTRODUCTION) AN ORDINANCE OF THE CITY OF ANAHEIM adding, repealing and amending various sections and subsections of Titles 10, 11 and 12 of the Anaheim Municipal Code relating to public services and utilities, public property, and streets and sidewalks, respectively. A 17. Approve minutes of the Council meetings held March 18, 2003, March 25, 2003 and April 1, 2003. END OF CONSENT CALENDAR Report on Closed Session Actions: None Council Communications: Council Member McCracken remembered Rudy Escalante who recently passed away. She recalled his long service and dedication to the community. Council Member Chavez and others spoke about an Anaheim family member who lost his life serving in the military, Edward Smith. Mayor Pringle requested the consideration of appointment of members to the newly created Golf Commission be placed on the April 29,2003 agenda. He also asked the City Attorney to bring forward modifications to the City's campaign reform ordinance to the April 29, 2003 agenda. He requested reorganization of the City's boards and commissions be calendared in the near future, consideration being given to combining some and adding the creation of a Sesquicentennial Commission for the City's 150th anniversary.
