RESOLUTION 2018-124
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING PUBLIC UTILITY EASEMENTS
LOCATED 3319 AND 3321 WEST LINCOLN AVENUE
PURSUANT TO CALIFORNIA STREETS AND HIGHWAYS
CODE SECTION 8330, ET SEQ. - SUMMARY VACATION.

WHEREAS, an applicant has requested the vacation of certain public utility
easements generally located at located at 3319 and 3321 West Lincoln Avenue, in the City of
Anaheim, County of Orange, State of California, as more particularly described below (individually,
"Public Service Easement" and collectively, "Public Service Easements"), in order to clear title to the
land because the electrical facilities of the City of Anaheim ("City of Anaheim") have been relocated;
and
WHEREAS, the City of Anaheim acquired the Public Service Easements for public
utility purposes ("Public Utility Purposes"); and
WHEREAS, the Public Service Easements are not necessary for present or
prospective Public Utility Purposes or any other public purpose; and
WHEREAS, the Public Service Easements to be vacated have been superseded by
relocation and there are no other public facilities located within the Public Service Easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of (1) the Public Service Easement recorded April 24,1964
in Book 7019, Page 306 as Instrument Number 23140 of Official Records and (2) a portion of the
Public Service Easement recorded April 24, 1964 in Book 7019, Page 307 as Instrument Number
23141 of Official Records, both Public Service Easements later assigned to the City of Anaheim per
an Assignment recorded January 2, 1975 in Book 11316, Page 1778 as Instrument Number 641 of
Official Records of Orange County. The Public Service Easement shall be vacated to the extent
shown on Exhibit "A" attached hereto and incorporated by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized and
directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the vacated Public Service Easements shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 11 day of September , 2018, by the following roll call vote:
AYES: Mayor Tait and Council Members Moreno, Vanderbilt,
Barnes, Kring, and Faessel
NOES: None
ABSENT:Council Member Murray
ABSTAIN: None
