RESOLUTION NO. 89R-357
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN
CONDITIONS OF APPROVAL IN VARIANCE NO. 3747
AND AMENDING RESOLUTION NO. 88R-108.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 88R-108 approving Variance No.
3747, subject to certain conditions specified therein; and
WHEREAS, the permittee has now requested an amendment to
certain of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on August 15, 1989, at which hearing the City Council did
receive and consider evidence, both oral and documentary, relating
to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the
public peace, health, safety or general welfare, or necessary to
permit reasonable operation under said Variance No. 3747.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Variance No. 3747 be, and the same are hereby, amended by (1)
the deletion of Condition No.8 therefrom; and (2) amending
Condition No.4 thereof to read as follows:
"4. That subject property shall be developed in
accordance with plans and specifications on file
with the City of Anaheim marked Exhibit Nos. 1, 2
and 3; and that the maximum building height of each
building on lots 1-9, 11-28, 30, 31 and 38-41 shall
not exceed 35 feet (including chimneys, etc.); and
further that the maximum building heights on lots
33-37 shall not exceed twenty-five (25) feet except
as otherwise permitted by Anaheim Municipal Code
Section 18.84.042."
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolution No. 88R-108 shall remain in full force and
effect.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be
and the same are hereby authorized to execute any and all
documents necessary to release the covenant heretofore executed
and recorded in favor of the City of Anaheim pursuant to the
Condition of Variance No. 3747 herein deleted.

THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 15th day of August, 1989.
