RESOLUT ION NO. 89R-371
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ESTABLISHING A PUBLIC STREET
FACILITIES PLAN FOR THE SANTA ANA CANYON ROAD
AREA OF BENEFIT.
WHEREAS, Section 17.08.433 of Chapter 17.08 of Title 17
of the Anaheim Municipal Code permits the City Council to
establish public street facilities plans; and
WHEREAS, the City Council does hereby find and determine
as follows:
1) That the area (hereinafter "Area") located generally
east of Imperial Highway, south of Esperanza Road,
south and southwest of Weir Canyon Road, and west
and north of the southern City Limits is presently
undeveloped or substantially undeveloped.
2) That the Area is about to be developed with
residential and commercial land uses.
3) That the existing public street facilities are
inadequate to serve the Area when developed; and
WHEREAS, a Public Street Facilities Plan for the Area
(hereinafter the "Plan") has been formulated; and
WHEREAS, the Plan identifies the public street facilities
(including land, improvements, and equipment) which the City
Council does hereby determine are reasonably necessary to provide
adequate public street facilities to the area of benefit; and
WHEREAS, the Plan does establish the boundaries of the
area of benefit, the actual or estimated cost of the Public Street
Facilities and the method of apportionment of the cost of said
facilities; and
WHEREAS, a public hearing was held to consider the plan,
notice of which hearing was given in the manner required by law;
and
WHEREAS, the boundaries of the area of benefit are
outlined on that map (marked Exhibit A) entitled "Santa Ana Canyon
Road Area of Benefit - Public Street Facilities Plan" on file in
the Office of the City Clerk which boundaries are incorporated
herein by reference; provided, however, that excluded from said
boundaries and Area of Benefit are all parcels of property which
have been developed or substantially developed with residential
structures prior to the date of adoption of the Plan; and
WHEREAS, the estimated cost of the Public Street
Facilities is Eight Million Four Hundred Eighty-Seven Thousand Two
Hundred Nineteen Dollars ($8,487,219); and
WHEREAS, the method of apportionment is based upon the
source of the number of vehicle trips using the facilities
calculated on a dwelling unit basis for residential uses and a
square footage of building basis for commercial, industrial and
institutional uses.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby adopt and establish the plan
entitled "Public Street Facilities Plan for Santa Ana Canyon Road
Area of Benefit."
BE IT FURTHER RESOLVED that the fees established by the
Plan shall not apply to any project for which (i) building plans
were submitted to and accepted by, and the plan check fee paid to,
the City of Anaheim Building Division prior to the date of
adoption of this resolution, for purposes of obtaining building
permit approval, and (ii) for which construction is commenced and
diligently prosecuted to completion prior to the expiration of
said building permit.
THE FOREGOING RESOLUTION is approved and adopted by the
Ci ty Counci 1 of the Ci ty of Anaheim this 22nd day of August, 1989.
