RES-1989-382 RESOLUTION NO. 89R-382 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 3183. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from RAYMOND ASSOCIATES, 811 W. 7th Street, Suite 310, Los Angeles, CA 90017, owner, and BOWER PEREZ ASSOCIATES, 811 W. 7th Street, Suite 310, Los Angeles, CA 90017, agent, to permit industrially-related sales businesses and office uses in the ML "Industrial, Limited" Zone. Upon certain real property located within the City of Anaheim, County of Orange, State of California, legally described as: THAT PORTION OF THE FRACTIONAL NORTHEAST QUARTER OF SECTION 3, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO SAN JUAN CAJON DE SANTA ANA, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT 10 CHAINS SOUTH OF THE NORTHEAST CORNER OF SAID SECTION 3, THENCE SOUTH 10 CHAINS ALONG THE SECTION LINE, THENCE WEST 20 CHAINS PARALLEL TO THE NORTHERLY LINE OF SAID SECTION, THENCE NORTH 10 CHAINS AND THENCE EAST 20 CHAINS TO THE POINT OF BEGINNING; and WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC89-196 granting Conditional Use Permit No. 3183; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and GRNTG CUP 83183 WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consi- deration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoin- ing land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that, for the reasons hereinabove stated, Conditional Use Permit No. 3183 be, and the same is hereby, granted permitting certain specified industrially-related sales businesses and office uses in the "ML" Industrial, Limited Zone on the hereinabove described real property, subject to the following conditions: 1. That prior to issuance of a building permit, the appropriate drainage assessment fees shall be paid to the City of Anaheim in an amount as determined by the City Engineer. 2. That the access ramp apron at the northwest corner of Raymond Avenue and Orangefair Lane shall be replaced to the satisfaction of the City Engineer. 3. That a parking plan showing compliance with City of Anaheim parking lot design standards shall be submitted to and approved by the City Traffic Engineer. 4. That a traffic signal shall be installed at the intersection of Orangefair Lane and Raymond Avenue. Said signal system shall be designed and placed in a manner acceptable to and approved by the City Traffic Engineer. -2- GRNTG CUP 63183 5. That a water main shall be extended from Raymond Avenue to the west side of Building No. 18, as required by the Water Utility Division. 6. That street lighting facilities along Raymond Avenue shall be installed as required by the Utilities General Manager in accordance with specifications on file in the Office of Utilities General Manager; or that security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above-mentioned improvements. Said security shall be posted with the City of Anaheim prior to issuance of a building permit. The above-required improvements shall be installed prior to occupancy. 7. That the new construction authorized by this resolution shall be served by underground utilities. 8. That prior to commencement of structural framing, fire hydrants shall be installed and charged as required and approved by the City Fire Department. An all-weather road must be provided to the hydrant at all times. 9. That fire sprinklers shall be installed as required by the City Fire Department. 10. That all driveways on Raymond Avenue shall be constructed with ten (10) foot radius curb returns, that existing broken or cracked driveways shall be removed and replaced, and that driveways shall be realigned as required by the City Traffic Engineer. 11. That trash storage areas shall be provided and maintained in a location acceptable to the Street Maintenance and Sanitation Division and in accordance with approved plans on file with said Division. Such information shall be specifically shown on the plans submitted for building permits. 12. That all air conditioning facilities and other roof and ground mounted equipment shall be properly shielded from view. Such information shall be specifically shown on the plans submitted for building permits. 13. That the proposal shall comply with all signing requirements of the ML "Industrial, Limited" Zone, unless a variance allowing sign waivers is approved by the City Council, Planning Commission or Zoning Administrator. 14. That the on-site landscaping and irrigation system shall be maintained in compliance with City standards. -3- GRNTG CUP 83183 15. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 3. 16. That prior to issuance of a building permit or within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 1, 3, 6, 11, and 12, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 17. That prior to final building and zoning inspections, Condition Nos. 2, 4, 5, 6, 7, 9, 10, 11, 12 and 15, above-mentioned, shall be complied with. 18. That retail sales businesses shall be limited to the following uses and shall be confined to "Building No. 19" as identified on the hereinabove described plan and specifications: 1. Dry Cleaners 2. Hair Salon/Barber Shops, and Related Supplies 3. Lock and Key Companies 4. Office Supplies 5. Post Office and Mail Services 6. Print Shops/Photocopy Services 7. Travel Agents 8. Any use permitted pursuant to Zoning Code Section 18.61.020, and subject to all conditions of said section. 19. That industrially-related office uses shall be limited to the following uses and shall be confined to "Building No. 19" as identified on the hereinabove described plans and specifications: 1. Accounting - Bookkeeping, CPA Firm or Temporary CPA Firms 2. Advertising 3. Appraisers 4. Banks 5. Brokers - Real Estate, Business Opportunities, Etc. 6. Business System Companies 7. Communication Consultants 8. Computer Analysis Firms 9. Credit Reporting Agencies 10. Designers - Industrial, Interior, Graphic 11. Development Companies 12. Facility Maintenance and Planning 13. Insurance Companies/Agencies 14. Inventory Services 15. Leasing Companies -4- GRNTG CUP 63183 16. Management Consultants/Companies 17. Marketing Research 18. Personnel Agencies 19. Quality Control Analysis 20. Secretarial and Business Services 21. Any use permitted pursuant to Zoning Code Section 18.61.020, and subject to all conditions of said Section. 20. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
