RES-1989-392 RESOLUTION NO. 89R-392 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF ELECTRIC ENERGY AS ADOPTED BY RESOLUTION NO. 71R-478 AND MOST RECENTLY AMENDED BY RESOLUTION NO. 88R-4. WHEREAS, the City of Anaheim maintains an electric generation and distribution system for the furnishing of electricity to residents and inhabitants of the City of Anaheim and has adopted Electric Rates, Rules and Regulations for the sale and distribution of electric energy; and WHEREAS, the Public Utilities Board held a public hearing on September 14, 1989 and evidence was presented in connection with the proposed revisions of Electric Rates, Rules and Regulations; and WHEREAS, the Public Utilities Board considered the California Environmental Quality Act and made the following findings: 1. The largest single expenditure category during the period of July 1, 1989 through June 30, 1990 is power supply at an estimated $139,783,000, excluding the cost of surplus power. 2. Other operating expenses and capital expenditures are estimated to cost $57,595,000. 3. Debt service requirements and an increase in reserve amounts estimated to cost $24.887,000 are required to meet financial reserves and requirements. 4. The transfer to the General Fund in an amount estimated to be $7,973,000 is authorized by the Ci~y Charter and constitutes an Intra-City transfer. 5. The decrease in working capital of $8,089,000 is required to meet the Utility's operating and capital expenses. 6. The matters covered in 1 through 6 above come within Section 21080 (b) (8) of the Public Resources Code of the State of California. Thus the establishment of these rates is exempt from the California Environmental Quality Act. WHEREAS, a Notice of Hearing was published as follows: 1. On August 28, 1989, notice of the public hearing on electric rates was published in the Anaheim Bulletin and proof thereof is on file with the Secretary of the Public Utilities Board. 2403h082289 2. On August 25, 1989. notice of the public hearing on electric rates was published in the Orange County Register and proof thereof is on file with the Secretary of the Public Utilities Board. 3. On August 25, 1989, notice of the public hearing on electric rates was published in the Orange County Edition of the Los Angeles Times and proof thereof is on file with the Secretary of the Public Utilities Board. WHEREAS, the Public Utilities Board has considered the proposal of the Public Utilities Department and has considered the evidence presented at the public hearing; and WHEREAS, the Public Utilities Board has made the following findings with respect to the need for changes to the Electric Rates, Rules and Regulations: 1. The Electric System revenue requirement of the Anaheim Public Utilities Department has been established, as set forth below, on the basis of projections for the 1989-90 fiscal year consisting of the twelve months July 1, 1989 through June 30, 1990. 2. A reasonable estimate of the revenue requirement for power supply costs for the 1989-90 fiscal year is $145.502,000 including the cost of surplus power, as shown in Exhibit DML-1. 3. A reasonable estimate of the revenue requirement for other operating expenses for the 1989-90 fiscal year is $23,634,000 as shown in Exhibit DML-1. 4. A reasonable estimate of the revenue requirement for capital expenditures for the 1989-90 fiscal year is $33,961,000 including $14,309.000 for construction of the Combustion Turbine Project, as shown on Exhibit DML-1. 5. A reasonable estimate of the revenue requirement for debt service and reserve build-up for the 1989-90 fiscal year is $24,887.000 as shown in Exhibit DML-1. 6. A reasonable estimate of the revenue requirement for transfer to the General Fund for the 1989-90 fiscal year is $7,973,000 as shown in Exhibit DML-1. 7. A reasonable estimate of the revenue requirement for a decrease in working capital for the 1989-90 fiscal year is $8,089.000 as shown in Exhibit DML-1. 8. A reasonable estimate of the revenue requirement offsets due to other electric revenues, bond proceeds, sale of surplus power, interest, and other income for the 1989-90 fiscal year is $40,335,000 as shown in Exhibit DML-1. 9. It is appropriate to perform a cost-of-service study in order to determine the allocated revenue requirement for the 1989-90 fiscal year for the following customer classes: Residential. Small Commercial, Large Commercial. Industrial, Agricultural and Pumping, Street Lights and Municipal. 11. It is appropriate to provide Anaheim's electric customers with reasonably stable rates and this is best accomplished at this time by setting the base rates as described in the testimony of Ms. Leach and Ms. Hoffman. These rates result in annualized base rate revenue of $191,084,000. Section 1221 of the City Charter provides that utility rates charged to a class of consumers shall be uniform within the class and shall be based on cost of service for the class. Section 1221 also provides that lifeline rates may be established which would not necessarily be based on cost of service. 13. It is appropriate to phase in rate changes to bring class revenues to their cost-of-service levels when one time changes would be burdensome to a particular customer class. The Department intends to bring rates more in line with cost of service over the next three rate cases. 2403h082289 14. The California Public Utilities Commission has established baseline rates for Southern California Edison Company (Edison) and Edison is the retail supplier of electric service in all the communities surrounding Anaheim, and therefore. it is appropriate to establish residential lifeline rates for Anaheim. 15. To the extent that the Anaheim lifeline rates produce lower revenues than would be produced by rates based on cost of service, the rates charged for nonlifeline sales must be increased above the level of rates based on cost of service. The difference between the revenues from sales made at the lifeline rates and revenues from those sales made at cost-of-service rates is the lifeline shortfall. 16. In allocating the lifeline shortfall to the nonlifeline customers, it is appropriate to give consideration to both cost of service and the retail rates of Edison. 17. On the basis of the preceding finding, the class revenues under the proposed base rates as shown in Exhibit RHH-2 are reasonable and appropriate. It is appropriate that the Power Cost Adjustment (PCA) account be taken to zero effective October 1, 1989. However, it is appropriate that the Department retain the PCA mechanism as an emergency procedure to hedge against sudden and unforeseen changes in power supply costs. When the PCA mechanism is activated, all revenues collected from the Utility's customers through the PCA are credited to the balancing account. All expenses for power costs, except for that included in base rates, are paid from the balancing account. All interest earned on funds in the PCA account will also be credited to that account. 2403h082289 19. It is appropriate to increase the Electric Utility Revenue from Sale of Bonds budget for 1989/90 from $0 to $43,365,000. 20. It is appropriate to decrease the Electric Utility power supply budget for 1989/90 from $154,779,526 to $145,502,000. 21. It is appropriate to decrease the Electric Utility revenue from sales budget for 1989/90 from $188,753,000 to $187,533,000. 22. It is appropriate to decrease the Electric Utility Rate Stabilization Account budget for 1989/90 from $28,729,000 to $3,603,000. 23. It is appropriate to increase the Electric Utility revenue from surplus sales budget for 1989/90 from $10,618,000 to $12,964,000. 24. It is appropriate to increase the Electric Utility revenue from the Power Cost Adjustment budget for 1989/90 from $0 to $3,858,000. WHEREAS, based on the findings hereinabove made, the Public Utilities Board of the City of Anaheim recommends to the City Council that the Council adopt the findings of the Public Utilities Board with respect to the matters contained herein and adopt the changes to the Electric Rates. Rules and Regulations as shown in Exhibit RHH-4. WHEREAS, the City Council has considered the evidence and concurs with the findings of the Public Utilities Board as set forth hereinabovu. NOW, THEREFORE BE IT RESOLVED that the findings of the Public Utilities Board be, and they are hereby. adopted by the City Council of the City of Anaheim. RULES AND REGULATIONS Page No. 1.0.1 CITY OF ANAHEIM ELECTRIC UTILITY POLICY Under the provisions of the California Constitution, the Charter of the City of Anaheim and Title 10 of the Municipal Code for the City of Anaheim, the City owus and operates both public utility services for water and electrical services for the citisens of Anaheim. The objectives of the Electric Utility organisation are to plan and carry out the development of the power resources of the City for the greatest benefit to the area and to the citisens of Anaheim. This includes providing dependable service without discrimination for the residents of the City of Anaheim to the fullest extent possible, consistent with overall sound business principles in planning, in financing, in construction of developments and in the operation and maintenance of the City's utility facilities. The accomplishments of these objectives will mate the maximum benefits to the public realized. It is recognized that the City Council is the governing body of the City and that it provides the utility services to the citizens of Anaheim. Through the City Council's direction and guidance, the City's management and supervisory personnel are continually anticipating the electrical service and related needs of all the customers in the community and expect to be responsive to their needs and requirements. SCHEDULE PCA POWER COST ADJUSTMENT APPLICABILITY When in effect, this schedule is applicable to all areas served by the Utility and to all kilowatt-hours billed under all rate schedules as defined under the special conditions of the rate schedules. PURPOSE Generally, power supply costs will be recovered through application of the base rates. In the event that substantial chaDqes in projected power supply costs occur, either increases or decre..es, the Power Cost Adjustment Billing Factor will be activated to provide for incre..es or decre..es in the Utility's charges for electric service. The Public Utilities Department General MaDaqer shall develop, .. appropriate, a PeA Billinq Factor to be effective on a date deterained by the Public Utilities Department following the approval of the City Council. D DOMESTIC SERVICE (Continued) A, LIFELINE SERVICE (Continued) Procedure for Certification The Utility may require that: a. The customer have a medical doctor or osteopath licensed to practice medicine in the State of California providing the Utility with a letter, acceptable to the Utility, describing the type of regularly required life-support device and the utilisation requirements in detail; or b. County, State, or Federal agencies, using an established notification letter to electric utilities, provide the Utility with information relative to patients who regularly require the use of a life-support device in the home. Upon the above certification, the Utility shall estimate the monthly consumption of the particular life-support device, given the usual hours of operation per month, and within 30 days add the incremental estimated monthly usage to the customer's lifeline quantity. The Utility may require a new or renewed application and/or certification when needed, in the opinion of the Utility. 7. Verification. Not more than one lifeline quantity will be allowed for each single-family dwelling or accommodation on the premises for each of the end uses set forth in Paragraphs 3, 4, 5 and 6 above. However, where there are multiple life-support devices at such single-family dwelling or accommodation, all such certified devices shall be totaled for one lifeline quantity, The number of .ingle-family accommodations on the premises and the existence of the specified end use equipment required to obtain certain lifeline quantities of electricity, as set forth on the applicable rate schedules, are subject to verification by the Utilities. In the event the Utility ascertains that the customer is not eligible for such additional lifeline quantity, such customer may be rebilled as if no such additional lifeline quantity had been allowed. 8. MOTOR PROTECTION AND EQUIPMENT Customer's motor equipment must conform with the followinq requirements. 1. Motors that cannot be subjected safely to full rated voltaqe on startinq, or that drive machinery of such a nature that the machinery itself, or the product it handles will not permit the motor to resume normal speed upon the restoration of normal supply voltaqe shall be equipped with devices that will disconnect them from the line upon failure of supply voltaqe and that will prevent the automatic reconnection of the motors upon restoration of normal supply voltaqe. 2. All motors of 1 hp or larqer shall be equipped with thermal relays, fuses, or other automatic overcurrent interruptinq devices to disconnect completely such motors from the line as a protection aqainst damaqe due to overheatinq. 3. Three-phase motors drivinq elevators, hoists, tramways, cranes, conveyers or other equipment, which would create hazard to life in the event of uncontrolled reversal of motor rotation, shall be provided with reverse-phase and open-phase protection to disconnect completely the motors from the line in the event of phase reversal or loss of one phase. 4. Wind machines thermostatically controlled with automatic reclosinq switches must be equipped with suitable time-delay devices, such as hereinafter specified, at the customer's expense, to permit the required adjustment of the time of reclosure after interruption of service. A suitable time-delay device, within the meaninq of this rule, is a relay or other type of equipment that can be present to delay with various time intervals the reclosinq of the automatic switches (and the consequent startinq up of the electric motors on the wind machines) and to staqqer the reconnectioD of the load on the Utility's system, and such device must be constructed so as effectively to permit a variable overall time interval of not less than five minutes with adjustable time increments of Dot qreater than ten seconds. The particular settinq to be utilitized for each separate installation is to be determined by the Utility from time to time in accordance with its operatinq requirements, and the customer is to obtain from the Utility the setting for each installation as thus determined. INTERFERENCE WITH SERVICE 1. Customers who operate equipment which causes detrimental voltage fluctuations (such as, but not limited to, hoists, welders, radio transmitters, X-ray apparatus, elevator motors, compressors, and furnaces) reasonably must limit such fluctuations upon request by the Utility. The customer will be required to pay for whatever corrective measures are necessary. 2. In the case of arc furnace installations not in ezcess of 100 EVA single-phase, or 300 IVA three-phase, the Utility may furnish energy at 240 or 480 volts, providing the customer permanently installs suitable equipment to limit secondary short-circuit current values to 300' of full load value. In the case of arc furnace installation in ezcess of 100 EVA, single-phase, or 300 EVA three-phase, the Utility may require the customer to provide, at his own ezpense, special furnace type transfo~ers and reactors sufficient to limit secondary short-circuit current values to 300' of full load value. In such cases, the Utility shall furnish energy at standard voltages over 5,000 volts. 3. Any customer who superimposes a current of any frequency upon any part of his electrical system, other than the current supplied by the Utility, shall, at his own ezpense, prevent the transmission of such current beyond his electrical system. G. POWER FACTOR The Utility may require the customer to provide, at his own ezpense. equipment to increase the operating power factor of each complete unit of neon, fluorescent, or other gaseous tube lighting equipment to not less than 90', lagging or leading. The customer shall pay a monthly charge for the added facilities in an amount determined by the Utility, which is based upon the added investment and governed by the agreement entered into prior to installation and rendering service. If, because of unusual conditions or for reasons beyond its control, the Utility is unable to read the customer's meter on the scheduled reading date, the Utility may bill the customer for estimated consumption during the billing period, and make any necessary corrections when a reading is obtained. Estimated consumption for this purpose will be calculated considering the customer's prior usage, the Utility's experience with other customers of the same class in that area, and the general characteristics of the customer's operations. Adjustments for any underestimation or overestimation of a customer's consumption will be reflected on the first regularly scheduled bill rendered and based on an actual reading following t~~ any periods ~f/l~.tt~~~l~lZltt when estimation was required. SERVICE DETRIMENTAL TO OTHER CUSTOMERS The Utility will not provide service to utilizing equipment. the operation of which will be detrimental to the service of the Utility or its other customers. and will discontinue electric service to any customer who shall continue to operate such equipment after having been given notice by the Utility to cease so doing. FRAUD The Utility may refuse or discontinue service if the acts of the customer or the conditions upon ~1. the cuato.er's premises are such as to indicate to it an intent to defraud the Utility. F. FAILURE TO ESTABLISH OR REESTABLISH CREDIT If, for an applicant's convenience, the Utility should provide service before credit is established or should continue service to a customer when credit has not been reestablished in accordance with Rule No.6, and ~~ the custo.er fails to establish or reestablish ~1. credit, the Utility may discontinue service. G. NONCOMPLIANCE Except as otherwise specifically provided in this Rule No. 11, the Utility may discontinue service to a customer for noncompliance with tariff schedules if, after written notice of at least 5 days, ~4 the custo.er has not complied with the notice. The Utility may dispense with the giving of such notice in the event there exists in the Utility's opinion a dangerous condition, thus rendering the immediate discontinuance of service to the premises imperative. H. CUSTOMER'S REQUEST FOR SERVICE DISCONTINUANCE When a customer desires to terminate ~1. responsibility for service, ~4 the custo.er shall give the Utility not less than two days' notice of this intention, state the date on which ~. the custo.er wishes the termination to become effective, and provide the Utility with the address to which the closiDq bill abould be aailed. EFFECTIVE RATES The rates charqed by the Utility for electric service are those on file with the Public Utilities General Manaqer, City of Anaheim, and leqally in effect. A copy of complete tariff schedules as filed with the Public Utilities General Manaqer, shall be maintained for public inspection at the Public Utilities Department. B. OPTIONAL RATES 1. Where there are two or more rate schedules, rates, or optional provisions applicable to the class of service requested by the applicant, the Utility or its authorized employees will call applicant's attention, at the time application is made, to the several schedules, and the applicant must designate which rate schedule, rate, or optional provision he desires. When the customer notifies the Utility of any material chanqe in the size, character, or estent of his utilizing equipment or operations, in accordance with Section C. of Rule No.3, the Utility will, within a reasonable time, advise the customer of the resulting rate options. In the absence of the notification provided for in Section C. of Rule No.3, the Utility assumes no responsibility of advising the customer of lower optional rates under other esisting schedules, rates. or optional provisions available as a result of the customer's chanqes in equipment or operations. 2. EST~BLISHMENT OF TEMPOR~RY SERVICE The City shall, if no undue hardship to its existing customers will result therefrom, furnish temporary service under the following conditions: 1. The applicant shall pay, in advance or otherwise as required by the City. the estimated cost installed plus the estimated cost of removal. less the estimated salvage of the facilities necessary for furnishing service. 2. The applicant shall establish credit as required by Rule No.6, except that the amount of deposit prescribed in Rule No. 7 shall not exceed the estimated bill for the duration of service. 3. If service is requested to any structure not of a permanent construction with a foundation, or which can be classified as removable, such as trailers, billboards, sheds, signs, etc., they shall be determined to be temporary and applicable to the terms and conditions of the requirements above of this Rule. 4. Temporary service for construction purposes shall be discontinued to the applicant and removed if it is used for other than the intended purpose. With the Utility's approval, a temporary service may be used for non-construction purposes when all applicable safety and construction codes are adhered to. If a non-utility approval power source is connected on the construction site, the Utility's temporary service shall be discontinued. The Public Utilities Depart.ent ~lt; will exercise reasonable diligence to furnish a continuous and sufficient supply of electricity to its customers and to avoid any shortage or interruption of delivery thereof. It cannot, however, guarantee a continuous or sufficient supply or freedom from interruption. 2. The Public Utilities Depar~nt elt; will not be liable for interruption or shortage of supply, nor for any loss or damage occasioned thereby. 3. Whenever, in the operation of the Public Utilities Depar~nt's elt; electric plants. properties, and/or systems, interruption in the delivery of electric energy to customers results from or is occasioned by causes other than the exercise by the Public Utilities Department of its right to suspend temporarily the delivery of electric energy for the purpose of making repairs or improvements to its system, notice of any such interruption will not be given to the customers of the Public Utilities Department, but the Public Utilities Department shall exercise reasonable diligence to reinstitute delivery of electric energy. B. TEMPORARY SUSPENSION FOR REPAIRS 1. The Public Utilities Depar~nt ~lt;, whenever it shall find it necessary for the purpose of making repairs or improvements to its system. will have the right to suspend temporarily the delivery of electricity. In all cases, as reasonable notice thereof as circumstances will permit will be given to the customer, and the making of such repairs or improvements will be prosecuted as rapidly as may be practicable and, if practicable, at such times as will cause the least inconvenience to its customers. 2. When it is necessary to suspend temporarily the delivery of electricity for repairs or improvements to the system in accordance with Paragraph B-1 above, and the customer requests that such suspension of service occur at other than normal Public Utilities Department working hours, the customer shall pay in advance, the total estimated labor related costs incurred by the Public Utilities Department for performing the work during non-regular Public Utilities Department work hours. C. APPORTIONMENT OF SUPPLY DURING TIME OF SHORTAGE Should a shortage of supply ever occur, the Public Utilities Department will apportion its available supply of electricity among its customers as authorized or directed by the Public Utilities General Manager in the manner that appears to him most equitable under conditions then prevailing. GENERAL The Utility will construct. own, operate and maintain lines only along public streets, roads and highways which the Utility has the legal right to occupy, and on public lands and private property across which rights of way satisfactory to the Utility may be obtained without cost or condemnation by the Utility. B. OVERHEAD EXTENSIONS TO INDIVIDUAL APPLICANTS FOR SERVICE 1. Except for those instances where the customer requests special facilities, the Utility will install, own and maintain the necessary transformers, meters, and service wires in accordance with Rule No. 16. 2. Special Facilities. Under this rule the Utility shall install only those facilities which it deems are necessary to render service in accordance with the tariff schedules. Where the applicant requests facilities which are in addition to, or in substitution for, the standard facilities which the Utility normally would install, the extra costs thereof shall be paid by the applicant. C. OVERHEAD EXTENSIONS TO SERVE SUBDIVISIONS OR TRACTS, HOUSING PROJECTS, AND MULTIFAMILY DWELLINGS 1. Not applicable to line extensions within a new single family and/or multifamily residential subdivision of five or more lots (subdivision) and in a new residential development consisting of five or more dwelling units in two or more buildings located on a single parcel of land (development) unless a master plan, preliminary map or tentative map has been filed for the subdivision or development with the City of Anaheim Planning Commission on or prior to May 5, 1970, and where an agreement has been entered into with the Utility for electric service prior to May 5, 1972. Upon a bona fide application for service, and where the Utility's distribution pole line is located on the customer's premises, or on a street, highway, lane, alley, road, or private easement immediately contiguous thereto, the Utility will, at its own expense, furnish and install a single span of service wires from its pole to the customer's first permanent support, provided such support is of a type, and is so located that such service wires may be installed to a point approved by the Utility in accordance with good engineering practice, and in compliance with all applicable laws, ordinances, rules and regulations, including those governing clearances and points of attachments. b. Impaired Clearance. Whenever any of the clearances required by the applicable laws, ordinance., rules or regulations of public authorities from the .ervice drop. to the ground or any object become impaired by reason of any changes made by the owner or tenant of the premises, the customer shall, at his own expense, provide a new and approved support, in a location approved by the Utility, for the termination of the Utilty's existing service drop wires and shall also provide all .ervice entrance conductors and equipment necessitated by the change of location. c. Service Entrance Conductors. For each overhead service connection, the cu.tomer shall furnish at hi. own expense a set of service entrance conductors which shall extend from the point of service delivery at the point of termination of the Utility'. .ervice drop on the customer's support to the customer's meter switch. Such .ervice entrance conductors shall be of a type and be in an enclosure which meets with the approval of the Utility and City Electrical Inspector-Building Division-Development Services Department. Number of Services to be Installed a. The City will not install more than one service for the same voltage and phase classification for anyone building or group of buildings on a single premises, ezcept as separate services may be installed for a separate building or for groups of buildings, where necessary for the operating convenience of the City. Where the customer has provided a concrete pad or foundation within an approved enclosure, located outdoors, he shall also furnish and install, at his expense, all secondary equipment and materials necessary to receive service at the secondaries of the transformers or the secondary bus. The City will, at its own expense, complete the installation. d. The City reserves the right to specify the type of transformer installation to be used. Each normal installation shall include, where necessary, facilities for one standard transformation. D. SPECIAL SERVICES Premises for which arrangements are made for any special type of service (such as but not limited to: three phase service to a residence, emergency, X-ray, welder, or transmitter service) will be served only by underqround connection where general service to the premises is by underground connection. PURPOSE The Rate Stabilization Account is established as a means of providing more stable retail electric rates to the customers of the City's Electric Utility. B. DEFINITIONS 1. Billing Rate - A forecasted average retail electric rate, in cents per kwh, based on the retail electric rates currently being billed to the Utility's customers. The Billing Rate includes the base rates and the Power Cost Adjustment Billing Factors. 2. Rate Stabilization Account (RSA) - A restricted cash account within the Electric Utility Operating Fund, Fund 55, which is utilized in stabilizing electric rates. The account initially is established with refund money received from Southern California Edison Company for prior overcharges on wholesale rates. 3. Rate Stabilization Account Interest - The interest earned on the monies in the RSA which is credited to the RSA. 4. Reference Rate - A forecasted average retail electric rate, in cents per kwh, required to provide sufficient revenue to meet expenditures and fund transfers of the approved Resource Allocation Plan (RAP) of the Electric Utility. 5. This rule sets forth requirements and conditions for interconnected non-City-owned qeneration where such qeneration may be connected for (1) parallel operation with the service of the City or (2) isolated operation with standby or breakdown service provided by the City. For purposes of this rule, the interconnectinq entity shall be designated the Producer. B. Conditions. 1. A Contract ezecuted by the City and the Producer shall be required for interconnected service. Terms for the purchase of power by the City if applicable, shall be included therein. 2. Interconnection with the City's system shall not be made until and unless the City has determined that the interconnection complies with the design and operatinq requirements set forth herein. 3. Where interconnection protective equipment is owned, operated and/or maintained by the Producer, the Producer shall be responsible for damaqes to the City and/or to others arisinq 'at/'f fro. the misoperation or malfunction of the Producer-owned equipment. 4. The Producer is solely responsible for providinq adequate protection for the Producer's facilities interconnected with the City's system. C. Design and Operatinq Requirements. Each qeneration facility which is or can be connected to the City's electric system shall be desiqned and operated so as to prevent or protect aqainst the fo110winq adverse conditions on the City's system. Explanatory information, operating rules and guidelines for meeting the above requirements for Qualifying Facilities 100 kilowatts or less and Qualifying Facilities between 100 and 1000 kilowatts are contained in the City's Non-Firm Energy Contract and Non-Firm Capacity and Energy Contract. Qualifying Facilities larger than 1000 kilowatt will have operating rules and interconnection standards as determined by the City when the Producer submits plans and specifications to the City. Copies of said Contracts are available from the City. D. Interconnection Facilities. 1. Interconnection facilities include all required means, and apparatus installed, to interconnect the Producer's generation with the City's system. Where the Producer desires to sell power to the City, interconnection facilities include all required means, and apparatus installed, to enable the City to receive power deliveries from the Producer. Interconnection facilities may include, but are not limited to: a. Connections, transformations, switching, communications. control. protective and safety equipment, accessible visual disconnects; and b. Any necessary reinforcements and additions to the City's system by the City at the Producer's cost. 2. Where interconnection facilities are to be installed for the Producer's use as added facilities, the Producer shall advance to the City the installed cost of the added facilities. At the Producer's option. and where such Producer's generation is a qualifying facility (as defined by the Public Utilities Regulatory policies Act of 1978) and the Producer has established credit worthiness to the City's satisfaction, the City shall finance those added facilities it deems to be removable and reusable equipment. Such equipment shall include. but not be limited to, transformation, disconnection, and metering equipment. When a Producer wishes to reserve facilities paid for by the Producer, but idled by an energy sale conversion, the City shall impose a special facilities charge reimbursing the City for costs related to its operation and maintenance of the facility. When a Producer no longer needs facilities for which it has paid, the Producer shall, at a minimum, receive from the City credit for the net salvage value of the facilities dedicated to City use. If the City is able to make use of these facilities to serve other customers, the Producer shall receive the fair market value of the facilities determined as of the date the Producer either decides no longer to use the facilities or fails to pay the required maintenance fee. 4. The Producer shall be responsible for all costs for all of the feasibility studies for any interconnection project with the City system, including reasonable advance charges imposed by the City for such feasibility studies. 5. An interconnection line study for any Producer shall take no more than one year to complete by the City. 6. The Producer ahall be responsible for costs of telemetering and safety checks except to the extent that, under the City's effective tariffs, a comparable customer would not be similarly charged. 7. The City shall, upon request, give the Producer a binding estimate for line extension and interconnection costs; however, such estimates shall be in effect for a period not to exceed one year from the date provided. A reasonable breakdown of cost estimates shall also be provided in a form sufficiently detailed and understandable by the Producer. 8. The City shall have the right to inspect the Producer's interconnection facilities prior to the commencement of parallel operations and require modifications as necessary. 9. The site of interconnection facilities shall be accessible to City personnel. E. Interconnection Reinforcement and/or Additions. The City's effective tariffs governing interconnection costs and added or special facilities agreements shall be applied to line and system reinforcement and/or additions. For two or more Producers seeking to use an existing line, a first come, first served approach shall be used. This approach shall require that the first Producer to request an interconnection shall, pursuant to written agreement, have the right to use the existing line and shall incur no obligation for costs associated with future line capacity needed to accommodate other Producers or customers. The Producer's application for cogeneration facilities and interconnection to the City's facilities shall specify the date by which the Producer must begin construction. If that date passes and construction has not commenced. the Producer shall be given 30 days to correct the deficiency after receiving a reminder from the City that the construction start-up date has passed. If construction has not commenced after the 30-day corrective period, the City shall have the right to withdraw its commitment to the first Producer and offer the right to interconnect on the existing line to the next Producer in order. If two Producers establish the right of first-in-time simultaneously, the two Producers shall share the costs of any additional line capacity necessary to facilitate their cumulative capacity requirements. Costs shall be shared based on the relative proportion of capacity each Producer will add to the line. 3. The Producer shall be responsible for the costs of only those future system alterations which are necessary to maintain the interconnection standards for the Producer's particular interconnection facilities. The relevant interconnection standards shall be those in effect at the time the contract is signed. Should such alterations not be directly required by, or beneficial to the Producer, the Producer shall be treated'like any other customer on the City's system. F. Metering. 1. If the Producer desires to sell electric power to the City, the City shall provide, own and maintain at the Producer's expense all necessary meters and associated equipment to be utilized for the measurement of energy and capacity for determining the City's payment to the Producer pursuant to an applicable contract. 2. For purposes of monitoring generator operation and determination of standby charges, the City shall have the right to install generation metering at the Producer's expense. Where the Producer's generation is 1 MW or greater, telemetering equipment may also be required at the Producer's expense. 3.
