RESOLUTION NO. 89R-408
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING AN AMENDMENT TO
CERTAIN CONDITIONS OF APPROVAL IN VARIANCE
NO. 3747 AS APPROVED BY RESOLUTION NO. 88R-l08
(REHEARING)
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 88R-l08 approving Varia~ No.
3747, subject to certain conditions specified therein; and
WHEREAS, the permittee heretofore requested an amendment
to said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on said request on August 15, 1989, at which hearing the
City Council did receive and consider evidence, both oral and
documentary, relating to said request; and
WHEREAS, following said hearing, the City Council adopted
its Resolution No. 89R-357 approving an amendment to certain
conditions of approval in Variance No. 3747 and amending
Resolution No. 88R-l08; and
WHEREAS, within the time permitted by law, a request for
a rehearing of the decision contained in Resolution No. 89R-357
was received by the City Council pursuant to the provisions of
Section 1.12.100 of the Anaheim Municipal Code; and
WHEREAS, the City Council heretofore granted said request
for rehearing and did conduct a duly noticed rehearing on said
application for an amendment to certain conditions of Variance No.
3747 on October 10, 1989, at which hearing the City Council did
receive and consider evidence both oral and documentary, relating
thereto; and
WHEREAS, the City Council hereby finds and determines
that the amendment to said conditions of approval is not
reasonably necessary to protect the public peace, health, safety
or general welfare, nor necessary to permit reasonable operation
under said Variance No. 3747.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Variance No. 3747 as approved by Resolution No. 88R-108 shall
remain in full force and effect.
BE IT FURTHER RESOLVED that the Resolution No. 89R-357
be, and the same is hereby, rescinded.
VARIANCE NO. 3747
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 10th day of October, 1989.
