RES-1989-465 RESOLUTION NO. 89R-465 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT THE ZONING MAP REFERRED TO IN TITLE 18 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 89-90-20 to consider an amendment to the Zoning Map referred to in Title 18 of the Anaheim Municipal Code, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described and, at said hearing, did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty (40) days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing and granted the proposed amendment; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the same; and WHEREAS, the City Council does find and determine that the Zoning Map referred to in Title 18 of the Anaheim Municipal Code should be amended and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone and zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the City Council does hereby declare and indicate its intention to amend the Zoning Map of the City of Anaheim and to rezone and reclassify the following described property, situated in the City of Anaheim, County of Orange, State of California, and as shown on the map attached hereto marked Exhibit A and incorporated herein by this reference, to wit: Area 1: Approximately 3.6 acres generally bounded by Cypress Street to the north, Resh Street to the east, the alley north of Lincoln Avenue to the south and Citron Street to the west; and including those four lots on the southeast corner RECLASS 89-90-20 of Chartres Street and Resh Street, having approximately frontages of 125 feet on the south side of Chartres Street and 176 feet on the east side of Resh Street. Area 2: Approximately 2.8 acres consisting of those 18 lots located on the north and south sides of Chestnut Street, beginning approximately 165 feet west of the centerline of Harbor Boulevard and extending west approximately 420 feet tot he westerly terminus of said street. Area 3: Approximately 5.1 acres bounded by Cypress Street to the north, Clementine Street to the east, Chartres Street to the south and the alley east of Harbor Boulevard to the west, by reclassifying the zoning designation of said properties as follows: AREA 1: a) All properties currently zoned RM-200 (Residential, Multiple-Family) to be reclassified to the RM-400 (Residential, Multiple-Family) Zone. b) Those properties located on the west side of Resh Street currently zoned RM-400 (Residential, Multiple-Family) to be reclassified to the RS-OOO (Residential, Single-Family) Zone. c) All properties currently zoned PD-C (Parking District-Commercial) to be reclassified to the PD-C/RM-400 (Parking District-Commercial/ Residential, Multiple-Family) Zone. AREA 2: a) All properties currently zoned RM-200 (Residential, Multiple-Family) to be reclassified to the RM-400 (Residential, Multiple-Family) Zone. b) All properties currently zoned PD-C (Parking District-Commercial) to be reclassified to the PD-C/RM 2400 (Parking District-Commerical/ Residential, MUltiple-Family) Zone. -2- RECLASS 89-90-20 AREA 3: a) Those properties bounded by Cypress Street to the north, the alley east of Helena Street to the west and currently zoned RM-200 (Residential MUltiple-Family) to be reclassified to the RS-OOO (Residential, Single-Family) Zone. b) Those properties bounded by Cypress Street to the north, the alley east of Helena to the West, Chartres Street to the south and Clementine Street to the east, and currently zoned RM-200 (Residential, MUltiple-Family) to be reclassified to the RM-400 (Residential, Multiple-Family) Zone. subject to the following condition: "That prior to introduction of an ordinance re- zoning these properties the City Council shall approve General Plan Amendment No. 267 in its entirety." BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that the adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 12th day of December, 1989.
