RESOLUTION NO. 89R-468
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AN AMENDMENT
TO CERTAIN CONDITIONS OF APPROVAL IN
CONDITIONAL USE PERMIT NO. 2963 AN
AMENDING RESOLUTION NO. 88R-14.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 88R-14 approving Conditional Use
Permit No. 2963, subject to certain conditions specified therein;
and
WHEREAS, the conditions of said permit were heretofore
amended by Resolution No. 88R-426; and
WHEREAS, the permittee has now requested a further
amendment to said conditions of approval to extend the period of
said permit; and
WHEREAS, the City Council held a duly noticed public
hearing on December 12, 1989, at which hearing the City Council
did receive and consider evidence, both oral and documentary,
relating to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment to of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the
public peace, health, safety or general welfare, or necessary to
permit reasonable operation under said Conditional Use Permit; and
WHEREAS, the City Council further finds that said
Conditional Use Permit is being exercised in a manner not
detrimental to the particular area and surrounding land uses, nor
detrimental to the public peace, health, safety and general
welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Conditional Use Permit No. 2963 as amended be, and the same are
hereby, amended by the amendment of Condition No. 11 thereof to
read as follows:
"11. That this permit shall expire on January
12, 1991 unless an extension of time is requested by
the petitioner and is approved by the City in
accordance with provisions of Section 18.03.093 of
the Anaheim Municipal Code."
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Conditional Use Permit No. 2963 and Resolution No. 88R-14
shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 12th day of December,
1989.
