RESOLUTION NO. 89R-472
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT THE
ZONING MAP REFERRED TO IN TITLE 18 OF THE
ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED AND
THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD
BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a duly noticed public hearing in Reclassification
Proceedings No. 89-90-29 to consider an amendment to the Zoning Map
referred to in Title 18 of the Anaheim Municipal Code, and to
consider a change in the boundaries of the zone or zones
hereinafter mentioned and described and, at said hearing, did
receive evidence and reports from persons interested therein and
from its staff; and
WHEREAS, within a period of forty (40) days following
said hearing, the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing and approved the proposed amendment; and
WHEREAS, thereafter, within the time prescribed by law,
the City Council, at the request of the Planning Commission, caused
the review of said Planning Commission action; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing in
the manner provided by law and did give all persons interested
therein an opportunity to be heard and did receive evidence and
reports, and did consider the same; and
WHEREAS, the City Council has heretofore certified Final
Environmental Impact Report No. 299 by its Resolution No. 89R-47l,
relating in part to these zoning proceedings and has duly
considered the information contained therein and adopted certain
findings and a statement of overriding considerations in connection
therewith; and
WHEREAS, the City Council does find and determine that
the Zoning Map referred to in Title 18 of the Anaheim Municipal
Code should be amended and that the property hereinafter described
should be excluded from the zones in which it is now situated and
incorporated in the zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the City Council does hereby declare and
indicate its intention to amend the Zoning Map of the City of
Anaheim and to rezone and reclassify the following described
property, situated in the City of Anaheim, County of Orange, State
of California, to wit:
RECLASS 89-90-29
PARCEL 1
Parcell of Lot Line Adjustment Plat No. III as
recorded on September 19, 1983 as Instrument No.
83-4lll02 in official records of said Orange County,
more particularly described as beginning at the
Northwest corner of said Parcell; said corner also
being the True Point of Beginning; thence S 890 30'
10" E, 675.33 feet; thence S 170 24' 15" W, 539.66
feet; thence N 890 32' 10" W, 513.22 feet; thence N 00
04' 30" W, 516.69 feet to the True Point of Beginning.
PARCEL 2
Parcel 2 of Lot Line Adjustment Plat No. III as
recorded on September 19, 1983 as Instrument No.
83-411102 in official records of said Orange County,
more particularly described as beginning at the
Northwest corner of said Parcel 2; said corner also
being the True Point of Beginning; thence S 890 32'
10" E, 513.22 feet; thence S 170 24' 15" W, 48.22 feet
to a point; thence S 180 08' 50" W, 124.17 feet;
thence N 890 32' 10" W, 459.91 feet; thence N 00 04'
30" W, 164.45 feet to the True Point of Beginning.
PARCEL 3
That portion of Lot 4 of the Travis Tract as shown on
a map recorded in Book 5, Page 120 of Miscellaneous
Records of Los Angeles County, California, lying
easterly of the westerly line of that certain parcel
conveyed to Orange County Flood Control District in
deed recorded February 6, 1939 in Book 978, Page 432
of Official Records of Orange County, California.
Excepting therefrom, that portion included within the
south 50.00 feet, as described in that certain deed to
the County of Orange, Recorded December 7, 1965 in
Book 7764, Page 985 of said Official Records.,
into the "PR" PUBLIC RECREATION ZONE of the City of Anaheim and
retaining the "FP" FLOOD PLAIN OVERLAY ZONE designation heretofore
adopted for a portion of the subject property pursuant to Ordinance
No. 4261 and Section 18.90.020 of the Anaheim Municipal Code,
subject to the following conditions:
1. That adoption of the ordinance rezoning the subject property,
or any portion thereof, shall not occur prior to acquisition
of the subject property by the City of Anaheim.
2. That development of the project on the subject property as
identified and described in Final Environmental Impact Report
No. 299 ("project") shall comply with all of the mitigation

measures for said project, as described in the mitigation
monitoring program ("program") adopted for said project pursuant to
Paragraph 6 of City Council Resolution No. 89R-47l, prior to
issuance of the final certificate of occupancy for said project, or
at such earlier time as may be specified therefor in said program.
The mitigation measures for said project as described in said
program are hereby adopted by this reference as if set forth in
full herein and by this reference made express conditions of
approval for development of said project.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 27th day of December, 1989.
