A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM EXPRESSING SUPPORT OF SENATE BILL 689
REGARDING NEEDLE AND SYRINGE EXCHANGE PROGRAMS
WHEREAS, California State Senator John Moorlach introduced Senate Bill No. 689, on
February 22, 2019,which establishes guidelines for, and increases local control of,needle and
syringe exchange programs; and
WHEREAS, subject to compliance with all applicable state laws, regulations and local
ordinances, certain entities may apply to the State Department of Public Health ("Department")
to provide hypodermic needle and syringe exchange services in any location where the
Department determines that the conditions exist for the rapid spread of human immunodeficiency
virus (HIV),viral hepatitis, or any other potentially deadly or disabling infections that are spread
through the sharing of used hypodermic needles and syringes; and
WHEREAS, Senate Bill 689 would add a provision allowing the Department to authorize
a needle exchange program and location only if the city, county, or city and county in which the
entity will be operating has adopted an ordinance or resolution approving that authorization or
reauthorization; and
WHEREAS, in August of 2018 a needle exchange program was authorized by the
Department to operate in the City of Anaheim and the City submitted letters in opposition due to
concerns related to the proposed location,public safety, liability concerns, and impacts to quality
of life in impacted areas; and
WHEREAS,the City of Anaheim recognizes that properly located and regulated needle
exchange programs may help prevent the spread of blood-borne diseases, but regulation and
approval of locations must occur at the local level to avoid such programs being located near
schools,parks and playgrounds.Further, local regulation is needed to prevent and mitigate the
demonstrated negative effects of needle exchange programs, including,but not limited to,the
improper disposal of syringes and congregation of persons addicted to drugs near schools,parks
and playgrounds; and
NOW THEREFORE,BE IT RESOLVED that the City of Anaheim wishes to express its
support of Senate Bill 689 and its effort to preserve local control over needle and syringe
exchange programs. •
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of
Anaheim this 1 9th day of March ,2019,by the following roll call vote:
AYES: Mayor Sidhu and Council Members Kring, Barnes,
Faessel, and O'Neil
