2003-158RESOLUTION NO. 2003R- 158 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE URGENT NECESSITY FOR PERFORMING REPIPING AT THE ARROWHEAD POND OF ANAHEIM AND AUTHORIZING THE CITY MANAGER TO PROCEED WITHOUT ADVERTISING FOR BIDS WHEREAS, Section 1211 of the Charter permits the City Council to find that public works which are of urgent necessity for the preservation of life, health or property may be performed without formally advertising for bids; and WHEREAS, the condition of the chilled water piping at the Arrowhead Pond of Anaheim is in such poor and deteriorated condition that using the chilled water system may cause a major rapture to the system which will result in heavy damage to the facility; and WHEREAS, a mechanical engineering consultant engaged by the City has examined the piping system and has determined that its immediate replacement before the upcoming hockey season is required to prevent major damage to the Pond; and WHEREAS, the time for performing such work has been compressed because of the Stanley Cup Playoffs, which delayed the engineering assessment of the chilled water piping system, and the beginning of the upcoming hockey season, for which ice must be made in September, 2003; and WHEREAS, the City has initiated legal action against the contractors responsible for installing the piping which must now be replaced; and WHEREAS, the time required to advertise for bids for the piping replacement would consume much of the time available for effecting repairs to the system; and WHEREAS, the engineering firm providing project management has identified seven contractors with the expertise to replace the deteriorated piping system without damaging the facility; and WHEREAS, should the piping system fail as predicted, ice could not be maintained in the Pond and damage to he walls and ceiling and carpets would result from the pressurized water/glycol mixture in the system. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, two-thirds of the members concurring, as follows: 1. The replacement of the chilled water piping system in the Arrowhead Pond of Anaheim is, for the reasons set forth in this Resolution and the accompanying staff report, deemed to be of urgent necessity for the preservation of health and property. 2. Because of the urgent necessity for replacing the chilled water piping system, contracts for the repair thereof may be let without advertising for bids. 3. The City Manager shall report to the City Council on the progress of the chilled water piping replacement project within thirty days of the commencement of construction.
