RES-2019-075 RESOLUTION NO. 2019-0 7 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM POLICE MANAGEMENT ASSOCIATION AND THE CITY OF ANAHEIM WHEREAS, the City of Anaheim and the Anaheim Police Management Association (APMA) have met and conferred regarding wages and deferred compensation pursuant to a reopener in the current Memorandum of Understanding between the APMA and the City of Anaheim, effective January 15, 2018 through December 26,2019; and WHEREAS, APMA is in agreement with the recommendation contained in said Letter of Understanding;and WHEREAS,as a result thereof, a Letter of Understanding dated July 2,2019, between the parties has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim finds that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated July 2,2019,between APMA and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 16th day of July,2019 by the following roll call vote: AYES:Mayor Sidhu and Council Members Kring, Barnes, Brandman, Moreno, Faessel, and O'Neil NOES:None ABSENT:None ABSTAIN:None 1Ai e • I H' C TY OF ANAHEIM CITY CLERK F THE CITY OF ANAHEIM LETTER OF UNDERSTANDING between the ANAHEIM POLICE MANAGEMENT ASSOCIATION and the CITY OF ANAHEIM The Anaheim Police Management Association ("APMA") and the City of Anaheim ("ANAHEIM"), herein referred to collectively as the "PARTIES," have met and conferred and reached an agreement regarding compensation. The PARTIES have agreed to the following terms and conditions: (1) Effective the pay period beginning June 28,2019 through the pay period ending December 26,2019,ANAHEIM shall contribute one and one half percent(1.5%)of base pay per pay period for each APMA-represented employee with an active 457 Deferred Compensation Plan. ANAHEIM shall cease any such contributions upon separation from employment with ANAHEIM. Any newly employed APMA-represented employee shall receive such contributions effective prospectively upon opening an active 457 Deferred Compensation plan through the pay period ending December 26, 2019. (2) Pursuant to each APMA-represented employee's election, with the pay period ending August 8, 2019 and following City Council approval of this Letter of Understanding, ANAHEIM shall either contribute a one-time$2000 amount into each APMA-represented employee's 457 Deferred Compensation Plan or provide the same one-time amount to the employee in the form of a cash bonus. To the extent permitted under law, the PARTIES agree that this lump sum payment is not compensation earnable and will not be reported to Ca1PERS.
