The property owner is Tri-freeway Business Partner LP, Tri- Freeway Business, LLC and Peter Wang. REQUEST: The applicant requests approval of a conditional use permit (CUP) to permit and retain an existing church within an industrial and office complex. RECOMMENDATION: Staff recommends that the Planning Commission adopt the attached resolution, determining that this request is categorically exempt from further environmental review under the California Environmental Quality Act (Class 1, Existing Facilities) and approving Conditional Use Permit No. 2019-06018. BACKGROUND: The subject 3.4-acre property is currently developed with an industrial and office complex with four single story buildings. The property is located within the "I" Industrial zone and the General Plan designates the property for Industrial land uses. Surrounding land uses include a Fire Station to the west across Valley Street, apartments to the south across Crescent Avenue, a water retention basin to the east, and an industrial complex to the north across a flood control channel. Four churches are currently located within the industrial and office complex, including the applicant, Purely Evangelical Church. The applicant requests to permit and retain a church in Suites F and K of the complex. Purely Evangelical Church was established in May 2015 and started in the City of Long Beach. After a year, the church moved to Anaheim and subleased the space from Vineyard Church who did not have an active CUP. Since the space was unavailable for their regular services, Purely Evangelical Church met in the City Project Site CONDITIONAL USE PERMIT NO. 2019-06018 AUGUST 19, 2019 Page 2 of 5 of Buena Park and only used the Anaheim space for offices during the week. The City issued the church a business license in May 2016 for a church administration office only. At the end of 2018, Purely Evangelical Church was forced to relocate and decided to enter into a lease at its current location. In 2019, the church started using the tenant spaces as an assembly hall for religious activity. Purely Evangelical Church is the fourth church to apply for a CUP on the subject site. The Planning Commission approved the first CUP for God is Love Church in 2017, followed by Jungkm Church and Fullerton Agape Church in 2018. Code Enforcement sent a courtesy notice to the applicant in October 2017, informing the church operator of the need to apply for a CUP or cease operating. Since the church has decided to stay in Anaheim earlier this year, they submitted a CUP application in June 2019. The Code Enforcement case remains active, pending a determination on this application. PROPOSAL: The applicant requests to permit and retain a 1,625 square foot church within an existing industrial and office complex. The tenant space consists of an office, restrooms, an open lobby, and a 1,100 square foot worship hall. The church has two employees consisting of the pastor and an administrative secretary. There are approximately 48 adult members and six children that attend the church. The church offers Sunday services at 9 a.m. for about 12 members, and 11 a.m. for 36 members (including children). Approximately 15 adults attend a Friday night Bible study from 8 to 9 p.m. CONDITIONAL USE PERMIT NO. 2019-06018 AUGUST 19, 2019 Page 3 of 5 FINDINGS AND ANALYSIS: Before the Planning Commission may approve a conditional use permit, it must make a finding of fact that the evidence presented shows that all of the following conditions exist: 1) That the proposed use is properly one for which a conditional use permit is authorized by this code; 2) That the proposed use will not adversely affect the adjoining land uses, or the growth and development of the area in which it is proposed to be located; 3) That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use, in a manner not detrimental to either the particular area or health and safety; 4) That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and 5) That the granting of the conditional use permit under the conditions imposed, if any, will not be detrimental to the health and safety of the citizens of the City of Anaheim. Churches are within the “Community and Religious Assembly” class of use in the Municipal Code. The Code permits Community and Religious Assembly uses in the Industrial Zone, subject to approval of a CUP to ensure compatibility with the surrounding area. The City has not received any complaints regarding the religious services since the church began operating in early 2019. The use operates in a manner compatible with surrounding office, industrial, and residential uses, and staff does not anticipate that the use would create any adverse impacts to the surrounding area. Conditions of approval to ensure that the church continues to operate in a compatible manner have been included in the draft resolution. These conditions would require that all parking occur on-site prohibit a school use, or prohibit a daycare or preschool other than Sunday school during church services, without prior approval of a CUP. The industrial and office complex has 185 parking spaces. The Municipal Code does not specify a parking standard for Community and Religious Assembly uses; instead, staff reviews a Parking Letter or Parking Study, submitted by the applicant, which identifies the actual parking demand of the church to determine whether there is an adequate supply of parking for the use. The applicant submitted the attached Parking Tabulation Worksheet, indicating the parking demand for their church and the adjacent uses as part of the application. Based on the Parking Code requirements for the current uses in the complex, the parking analysis shows that all of the industrial and office uses combined requires a minimum of 127 spaces. Based on this analysis, there are 58 remaining spaces out of the 185 parking spaces for the existing churches to share. Since the four churches operate outside of normal weekday business hours, the churches are able to share all other on-site parking spaces during the weekend when other businesses are closed. CONDITIONAL USE PERMIT NO. 2019-06018 AUGUST 19, 2019 Page 4 of 5 The applicant conducted parking counts of the property on June 28, 2019 and July 12, 2019 during the Friday evening services (8 p.m. – 9:30 p.m.) and July 7, 2019 and July 14, 2019 for their Sunday services (9 a.m. and 11 a.m.). As shown in the following table, the applicant surveyed the entire complex and observed that vehicles occupied a maximum of 55 spaces out of the 185 parking spaces, with the 11 a.m. service having the highest volume of cars: Table 1. Staff observed that vehicles occupied 29 spaces at 9:15 a.m. and 69 cars at 11:10 a.m. throughout the entire center. Based on these observations, staff determined that there is more than enough parking for the existing businesses and the proposed church at the complex. Staff received three public inquiries about the project from residents at Stanford Court, which is located southeast of the project site. Two of the inquiries were opposed to the proposed church citing potential increased traffic. The concerns focused on existing traffic issues on Crescent Avenue. According to the residents, drivers cannot safely travel westbound on Crescent Avenue on Sunday mornings due to vehicular speeds and the number of cars traveling on the street. Staff believes that the proposed church is not significantly contributing to existing traffic concerns given that it’s a relatively small congregation of 36 members for the 11 a.m. Sunday service. Staff also believes that some of the traffic concerns are caused by existing churches in the area that have larger congregations. Additionally, Code Enforcement has not received any complaints from the surrounding residents regarding overflow or spillover parking into the adjacent neighborhoods. Based on the parking counts provided by the applicant and those conducted by staff, the operation of services during off-peak hours, and the lack of parking-related complaints on-site, staff believes that the church would have sufficient parking spaces available and would not impose an undue burden on the adjacent industrial and residential uses. Environmental Impact Analysis: Staff recommends the Planning Commission find that the effects of the proposed project are typical of those generated within the Class 1, Existing Facilities, Categorical Exemption. Class 1 consists of the repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of use beyond that existing at the time of this determination. The proposed project is a request to permit and retain a church within an existing office building. As such, the proposed project meets the criteria for a Class 1 categorical exemption. Pursuant to Section 15300.02 (c) and 15301 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project is categorically exempt from the provisions of CEQA. CONDITIONAL USE PERMIT NO. 2019-06018 AUGUST 19, 2019 Page 5 of 5 CONCLUSION: Staff believes that the existing church would be compatible with the surrounding land uses. The number of on-site parking spaces are adequate to serve the church and all surrounding uses based on the actual parking demand observed for the complex. Conditions of approval have been included to ensure that the church continues to operate in a compatible manner. The Anaheim General Plan designates the Property for Industrial land uses. The Property is located in the “I” Industrial Zone and is subject to the zoning and development standards contained in Chapter 18.10 (Industrial Zones) of the Anaheim Municipal Code (the "Code"); and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on August 19, 2019 at 5:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) of the Code, to hear and consider evidence for and against Conditional Use Permit No. 2019-06018 (the “Proposed Project”), and to investigate and make findings and recommendations in connection therewith; and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as “CEQA”), the State of California Guidelines for the Implementation of the California Environmental Quality Act (commencing with Section 15000 of Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), and the City's Local CEQA Procedure Manual, the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission finds and determines that the effects of the Proposed Project are typical of those generated within that class of projects (i.e., Class 1 – Existing Facilities) which consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of this determination, and that, therefore, pursuant to Section 15301 of the CEQA Guidelines, the Proposed Project will not cause a significant effect on the environment and is, therefore, categorically exempt from the provisions of CEQA; and - 2 - PC2019-*** WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for Conditional Use Permit No. 2019-06018, does find and determine the following: 1. The Proposed Project is an allowable use within the "I" Industrial Zone under subsection .010 of Section 18.10.030 (Uses) of Chapter 18.10 (Industrial Zones) of the Code, subject to a conditional use permit and the zoning and development standards of the "I" Industrial Zone. 2. The Proposed Project, under the conditions imposed, will not adversely affect the surrounding land uses and the growth and development of the area because the Property is developed with industrial buildings and there are a sufficient amount of parking spaces to accommodate the parking demand for the church and all surrounding uses combined. 3. The size and shape of the Property is adequate to allow the full operation of the proposed use in a manner not detrimental to the particular area or to the health, safety and general welfare because the church is located within an industrial building and a sufficient number of on- site parking spaces and adequate vehicle circulation are provided on-site. 4. The traffic generated by the use would not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because the number of vehicles entering and exiting the site will not exceed the anticipated volumes of traffic on the surrounding streets to accommodate the use. 5. The granting of Conditional Use Permit No. 2019-06018 under the conditions imposed will not be detrimental to the health and safety of the citizens of the City of Anaheim and will provide a land use that is compatible with the surrounding area. WHEREAS, the Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report and all materials in the project files. There is no substantial evidence, nor are there other facts, that detract from the findings made in this Resolution. The Planning Commission expressly declares that it considered all evidence presented and reached these findings after due consideration of all evidence presented to it. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Conditional Use Permit No. 2019-06018, and further contingent upon and subject to the conditions of approval set forth in Exhibit B attached hereto and incorporated herein by this reference, which are hereby found to be a necessary prerequisite to the proposed use of the Property under Conditional Use Permit No. 2019-06018 in order to preserve the health, safety and general welfare of the citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Code. Anaheim Boulevard, Suite 162 Anaheim, CA 92805 (714) 765-5423 | Ltong@anaheim.net From: Erin Retter <mrbeesmom@sbcglobal.net> Sent: Friday, August 16, 2019 1:01 PM To: Lucita Tong <LTong@anaheim.net> Subject: Traffic Survey request for Crescent Ave between Brookhurst & Crescent   Dear Lucita Tong,   I have been a homeowner/resident of the Stanford Court Townhomes since 1991 and my unit faces Crescent Ave.   When I first moved in, traffic noise was light and didn’t affect my ability to sleep even though I am a light sleeper.   Fast forward many years later and even after I replaced the windows in my home to block out as much noise as possible created by the traffic from the satellite campus of the Sa-Rang Community Church, the swish swashing noise from the traffic is non-stop on Sunday’s or whenever the church is having an event. I am not opposed to the church being there, occupied buildings are better for the area than empty vandalized properties, but without a signal to stop the flow of traffic to allow residents and visitors to enter and exit the complex it can take awhile and I have seen drivers take some serious risks to enter or exit the complex or almost get hit because there is no longer a left hand turn lane to enter the complex. Frequently when I am coming home from work in the evening when slowing down to make the right hand turn into the complex I have drivers speed around me into the left hand lane. NEW CORRESPONDENCE ITEM NO. 2 Since my unit faces Crescent Ave and because there is a big difference between the sound of reasonable speed traffic flow and high speed traffic flow I can tell you speeding along this stretch of road isn’t just the occasional irresponsible driver, it happens quite a bit even late at night. I strongly urge the City of Anaheim to conduct a traffic survey to document the traffic flow on Crescent Ave not only on Sunday’s, but during peak times when people are going to and coming home from work.
