RESOLUTION 2019- 112
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING VARIOUS PUBLIC UTILITY
EASEMENTS PURSUANT TO CALIFORNIA STREETS
AND HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABA2018-00383)
WHEREAS, an applicant has requested the vacation of various public utility
easements generally located at 901 East South Street, in the City of Anaheim, County of Orange,
State of California, as more particularly described below ("Public Service Easement"), in
conjunction with the development of a condominium and apartment site; and
WHEREAS, the City of Anaheim ("City of Anaheim") reserved or acquired the
Public Service Easements for public utility purposes ("Public Utility Purposes"); and
WHEREAS, the Public Service Easements are not necessary for present or
prospective Public Utility Purposes or any other public purpose; and
WHEREAS, the Public Service Easements to be vacated have been superseded by
relocation and there are no other public facilities located within the Public Service Easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the Public Service Easements as described in Exhibit
"A" attached hereto and incorporated by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution
shall not be effective until a certified copy of this Resolution is recorded in the Office of the
Recorder of the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, andis hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of
this Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation
shall be complete and the Public Service Easements vacated shall no longer constitute public
service easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Councilof the
City of Anaheim this 24 Day of September , 2019 by the following roll call
vote:
AYES: Mayor Sidhu and Council Members Kring, Barnes, Brandman,
Moreno, Faessel, and O'Neil
NOES: None
ABSENT: None

described as follows:
An easement for public utility purposes as accepted by the City of Anaheim City Council
Resolution No. 1936 on March 21, 1952 and recorded on September 24, 1957 in Book 4047,
Page 221-225 inclusive of Official Records of Orange County, California; and
An easement for storm drain facilities and incidental purposes as recorded October 31, 2000 as
Instrument No. 20000587222 of Official Records of Orange County,California; and
An easement for public utility purposes as recorded September 26, 2001 as Instrument No.
20010680546 of Official Records of Orange County, California.
An easement for underground drainage facilities,water pipe and water distribution boxes, as
reserved in the City of Anaheim City Council Resolution No. 63R-954 approved December 3,
1963 and recorded on December 17, 1963 in Book 5849, Page 15 in the Office of the County
Recorder of Orange County, California and all portions lying within Parcel Map No. 2017-120.
